كِتَاب الْبُيُوعِ
The Book of Sales (Bargains)
بَابُ لاَ يَبِيعُ عَلَى بَيْعِ أَخِيهِ وَلاَ يَسُومُ عَلَى سَوْمِ أَخِيهِ، حَتَّى يَأْذَنَ لَهُ أَوْ يَتْرُكَ:
(58) Chapter. A seller should not urge somebody (in case of optional sale) to cancle a bargain the latter has already agreed upon with another seller so as to sell him his own goods; and a buyer should not urge the seller to cencle a barbain already agreed upon with another buyer so as to buy the goods himself, unless they are given permission in both cases, or the bargains are cancelled with the willingness of both the seller and the buyer.

Hadith Number: 2139
حدثنا إسماعيل، قال: حدثني مالك، عن نافع، عن عبد الله بن عمر رضي الله عنه، ان رسول الله صلى الله عليه وسلم، قال:" لا يبيع بعضكم على بيع اخيه".
Narrated `Abdullah bin `Umar: Allah's Apostle said, "Do not urge somebody to return what he has already bought (i.e. in optional sale) from another seller so as to sell him your own goods."

Hadith Number: 2140
حدثنا علي بن عبد الله، حدثنا سفيان، حدثنا الزهري، عن سعيد بن المسيب، عن ابي هريرة رضي الله عنه، قال:" نهى رسول الله صلى الله عليه وسلم ان يبيع حاضر لباد، ولا تناجشوا، ولا يبيع الرجل على بيع اخيه، ولا يخطب على خطبة اخيه، ولا تسال المراة طلاق اختها لتكفا ما في إنائها".
Narrated Abu Huraira: Allah's Apostle forbade the selling of things by a town dweller on behalf of a desert dweller; and similarly Najsh was forbidden. And one should not urge somebody to return the goods to the seller so as to sell him his own goods; nor should one demand the hand of a girl who has already been engaged to someone else; and a woman should not try to cause some other woman to be divorced in order to take her place.
