كِتَاب الْمَظَالِمِ
The Book of Al-Mazalim
بَابُ إِذَا اخْتَلَفُوا فِي الطَّرِيقِ الْمِيتَاءِ- وَهْيَ الرَّحْبَةُ تَكُونُ بَيْنَ الطَّرِيقِ- ثُمَّ يُرِيدُ أَهْلُهَا الْبُنْيَانَ، فَتُرِكَ مِنْهَا الطَّرِيقُ سَبْعَةَ أَذْرُعٍ:
Chapter. When there is a dispute about a public way and the owner of the land wishes to build (something), he should leave seven cubits for the people to pass through.
Hadith Number: 2473
حدثنا موسى بن إسماعيل، حدثنا جرير بن حازم، عن الزبير بن خريت، عن عكرمة، سمعت ابا هريرة رضي الله عنه، قال:"قضى النبي صلى الله عليه وسلم إذا تشاجروا في الطريق بسبعة اذرع".
Narrated Abu Huraira: The Prophet judged that seven cubits should be left as a public way when there was a dispute about the land.
