Chapter. The Statement of Allah:“... After the payment of legacies he may have bequeathed or debts...”(V.4:11)
Hadith Number: Q2749
‘And it is transmitted that’ Qadi Shurayh, Umar bin Abdul Aziz, Tawus, Ata, and Abdur Rahman bin Azinah — these people considered the acknowledgment of debt during illness to be valid. And Imam Hasan al-Basri said: A person should be considered most truthful when it is his last day in this world and his first day in the Hereafter. And Ibrahim al-Nakha’i and Hakam bin Utbah said: If a sick person says to an heir,“I have no debt upon him,”then this discharge is valid. And Rafi’ bin Khadij (Companion) made a bequest that the wealth tied at the door of his wife Fazariyyah should not be opened. And Imam Hasan al-Basri said: If someone, at the time of death, says to his slave,“I have set you free,”then it is permissible. And al-Sha’bi said: If a woman, at the time of death, says,“My husband has given me my dowry and I have received it,”then it is permissible. And some people (the Hanafis) say: The acknowledgment of a sick person in favor of one heir, due to the suspicion of other heirs, is not valid. Then these same people say: If a sick person acknowledges a trust, deposit, or partnership, it is valid, even though the Prophet (peace be upon him) said:“Beware of suspicion, for suspicion is the greatest falsehood.”And O Muslims! (It is) not permissible to usurp the right of other heirs, because the Prophet (peace be upon him) said:“The sign of a hypocrite is that he betrays in trust.”And Allah the Exalted said in Surah al-Nisa:“Allah commands you to render trusts to whom they are due.”__QUR_N__ In this, there is no distinction between an heir or a non-heir. On this subject, a marfu’ hadith is narrated from Abdullah bin Umar (may Allah be pleased with them both).
