باب اسْتِبْرَاءِ الأَمَةِ:
Chapter: Ensuring a Slave Woman is Not Pregnant
Hadith Number: 1211
اخبرنا يزيد، حدثنا شريك، عن ليث، عن طاوس، في استبراء الامة إن لم تكن تحيض، قال: "خمسة واربعين".
It is narrated from Tawus, may Allah have mercy on him, that if a slave girl does not menstruate, then her waiting period for Istibra is forty-five (45) days.

اخبرنا يزيد، اخبرنا شريك، عن خالد الحذاء، عن ابي قلابة، قال: "ثلاثة اشهر".
Abu Qilabah (may Allah have mercy on him) said: Its period is three months.

اخبرنا محمد بن المبارك، عن عمر بن عبد الواحد، عن الاوزاعي، قال: سالت الزهري عن الرجل يبتاع الجارية لا تبلغ المحيض ولا تحمل مثلها، كم يستبرئها؟، قال: "ثلاثة اشهر".
It is narrated from Imam Awza'i, may Allah have mercy on him, that I asked Imam Zuhri, may Allah have mercy on him, if a man buys a minor slave girl who has neither menstruated nor is capable of becoming pregnant like those of her age, what will be the duration of her 'istibra' (waiting period)? He replied: Three months.

Hadith Number: 1214
وقال يحيى بن ابي كثير: "بخمسة واربعين يوما".
Yahya bin Abi Kathir has stated the period of Istibra’ (waiting period) for a slave woman to be 45 days.

اخبرنا الهيثم بن جميل، عن ابن المبارك، عن يحيى بن بشر، عن عكرمة، قال: "بشهر"، سئل عبد الله: بايهما تقول؟، قال:"ثلاثة اشهر اوثق، وشهر يكفي".
It is narrated from Yahya bin Bishr, Ikrimah (may Allah have mercy on him) said: (Its duration) is one month. Imam Darimi (may Allah have mercy on him) was asked: What is your opinion? He replied: Three months is a precautionary strong duration, and one month is also sufficient.
