باب إِذَا أَوْصَى الرَّجُلُ إِلَى الرَّجُلِ وَهُوَ غَائِبٌ:
Chapter on a man appointing an executor who is absent
Hadith Number: 3275
حدثنا حدثنا ابو النعمان، حدثنا هشيم، انبانا منصور، عن الحسن، انه كان يقول: "إذا اوصى الرجل إلى الرجل وهو غائب، فليقبل وصيته، وإن كان حاضرا، فهو بالخيار: إن شاء، قبل، وإن شاء، ترك".
Hasan (may Allah have mercy on him) used to say: If a man makes a bequest for someone who is absent, then he (the legatee) should accept that bequest, and if he (the legatee) is present, then he has the choice—if he wishes, he may accept it, and if he wishes, he may leave it.

Hadith Number: 3276
حدثنا صالح بن عبد الله، حدثنا حماد بن زيد، عن ايوب، قال: سالت الحسن، ومحمدا عن"الرجل يوصي إلى الرجل، قالا: نختار ان يقبل".
It is narrated from Ayyub (as-Sakhtiyani) that I asked Hasan and Muhammad, may Allah have mercy on them: If a person makes a bequest for someone, then what? Both said: He should accept the bequest.

حدثنا حدثنا محمد بن اسعد، حدثنا ابو بكر، عن هشام، عن الحسن، قال: "إذا اوصى الرجل إلى الرجل وهو غائب، فإذا قدم فإن شاء، قبل، فإذا قبل، لم يكن له ان يرد".
Hasan (may Allah have mercy on him) said: If a man makes a bequest to an absent person and he accepts it, then he will no longer have the option to reject it.

Hadith Number: 3278
حدثنا حدثنا الوضاح بن يحيى، حدثنا ابو بكر، عن هشام، عن الحسن، قال: "إذا اوصى الرجل إلى الرجل، فعرضت عليه الوصية، وكان غائبا فقبل، لم يكن له ان يرجع".
Hasan (may Allah have mercy on him) said: When a man makes a bequest for someone and that person is not present, then if the bequest is presented to him (the legatee) and he accepts it, the one who made the bequest no longer has the right to revoke it.
