حَدِیث رِجَال یَتَحَدَّثونَ
Hadith of men who were conversing
Hadith Number: 16619
(حديث مرفوع) حدثنا يحيى بن إسحاق ، قال: حدثنا ابن لهيعة ، عن عبيد الله بن ابي جعفر ، عن الفضل بن عمرو بن امية ، عن ابيه ، قال: سمعت رجالا يتحدثون عن النبي صلى الله عليه وسلم، انه قال:" إذا اعتقت الامة، فهي بالخيار ما لم يطاها، إن شاءت فارقته، وإن وطئها فلا خيار لها، ولا تستطيع فراقه".
It is narrated from several Companions (may Allah be pleased with them) that the Prophet (peace and blessings be upon him) said: When a slave woman is granted her freedom, she is given the choice, provided that her husband has not had intercourse with her; if she wishes, she may separate from her husband. But if he has had intercourse with her, then she no longer has this choice and separation cannot take place.

حكم دارالسلام: حديث حسن، وهذا إسناد ضعيف لضعف ابن لهيعة، وقد اختلف عليه فيه

(حديث مرفوع) حدثنا حسن ، قال: حدثنا ابن لهيعة ، قال: حدثنا عبيد الله ابن جعفر ، عن الفضل بن الحسن بن عمرو بن امية الضمري ، قال: سمعت رجالا من اصحاب رسول الله صلى الله عليه وسلم يتحدثون، ان رسول الله صلى الله عليه وسلم قال:" إذا اعتقت الامة وهي تحت العبد، فامرها بيدها، فإن هي اقرت حتى يطاها، فهي امراته لا تستطيع فراقه".
