كتاب الْأَيْمَانِ وَالنُّذُورِ
The Book of Oaths and Vows
بَابُ قَوْلِ اللَّهِ تَعَالَى: {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلاً أُولَئِكَ لاَ خَلاَقَ لَهُمْ فِي الآخِرَةِ وَلاَ يُكَلِّمُهُمُ اللَّهُ وَلاَ يَنْظُرُ إِلَيْهِمْ يَوْمَ الْقِيَامَةِ وَلاَ يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ}:
(17) Chapter. The Statement of Allah:“Verily, those who purchase a small gain at the cost of Allah’s Covenant and their oaths..." (V.3:77) And also the Statement of Allah: "And purchase not a small gain at the cost of Allah’s Covenant. Verily! What is with Allah is better for you if you did but know." (V.16:95) And fulfil the Convenant of Allah (Baia: pledge for Islam) when you have convenanted, and break not the oaths after you have confirmed them - and indeed you have appointed Allah your surety..." (V.16:91)
Hadith Number: Q6676
وقوله جل ذكره: {ولا تجعلوا الله عرضة لايمانكم ان تبروا وتتقوا وتصلحوا بين الناس والله سميع عليم}. وقوله جل ذكره: {ولا تشتروا بعهد الله ثمنا قليلا إن ما عند الله هو خير لكم إن كنتم تعلمون}، {واوفوا بعهد الله إذا عاهدتم ولا تنقضوا الايمان بعد توكيدها وقد جعلتم الله عليكم كفيلا}.
Hadith Number: 6676
حدثنا موسى بن إسماعيل، حدثنا ابو عوانة، عن الاعمش، عن ابي وائل، عن عبد الله رضي الله عنه، قال: قال رسول الله صلى الله عليه وسلم:" من حلف على يمين صبر، يقتطع بها مال امرئ مسلم، لقي الله وهو عليه غضبان"، فانزل الله تصديق ذلك: إن الذين يشترون بعهد الله وايمانهم ثمنا قليلا سورة آل عمران آية 77 إلى آخر الآية.
Narrated `Abdullah: Allah's Apostle said, "If somebody is ordered (by the ruler or the judge) to take an oath, and he takes a false oath in order to grab the property of a Muslim, then he will incur Allah's Wrath when he will meet Him." And Allah revealed in its confirmation: 'Verily! Those who purchase a small gain at the cost of Allah's covenants and their own oaths.' (3.77)
حكم: أحاديث صحيح البخاريّ كلّها صحيحة
Hadith Number: 6677
فدخل الاشعث بن قيس، فقال: ما حدثكم ابو عبد الرحمن، فقالوا: كذا وكذا، قال: في انزلت، كانت لي بئر في ارض ابن عم لي، فاتيت رسول الله صلى الله عليه وسلم، فقال:" بينتك او يمينه"، قلت: إذا يحلف عليها يا رسول الله، فقال رسول الله صلى الله عليه وسلم:" من حلف على يمين صبر وهو فيها فاجر، يقتطع بها مال امرئ مسلم، لقي الله يوم القيامة وهو عليه غضبان".
(The sub-narrator added:) Al-Ash'ath bin Qais entered, saying, "What did Abu `Abdur-Rahman narrate to you?" They said, "So-and-so," Al-Ash'ath said, "This verse was revealed in my connection. I had a well on the land of my cousin (and we had a dispute about it). I reported him to Allah 's Apostle who said (to me). "You should give evidence (i.e. witness) otherwise the oath of your opponent will render your claim invalid." I said, "Then he (my opponent) will take the oath, O Allah's Apostle." Allah's Apostle said, "Whoever is ordered (by the ruler or the judge) to give an oath, and he takes a false oath in order to grab the property of a Muslim, then he will incur Allah's Wrath when he meets Him on the Day of Resurrection."
