Book: On the Explanation of Divorce
بَابُ مَا جَاءَ فِي الْخَلِيَّةِ وَالْبَرِيَّةِ وَأَشْبَاهِ ذَلِكَ
Chapter on what is reported regarding the hive, wild animals, and similar cases
Hadith Number: 1136
حدثني حدثني يحيى، عن مالك، انه بلغه، انه كتب إلى عمر بن الخطاب من العراق، ان رجلا، قال لامراته: حبلك على غاربك، فكتب عمر بن الخطاب إلى عامله:" ان مره يوافيني بمكة في الموسم"، فبينما عمر يطوف بالبيت، إذ لقيه الرجل، فسلم عليه، فقال عمر:" من انت؟" فقال: انا الذي امرت ان اجلب عليك، فقال له عمر:" اسالك برب هذه البنية، ما اردت بقولك حبلك على غاربك"، فقال له الرجل: لو استحلفتني في غير هذا المكان ما صدقتك، اردت بذلك الفراق، فقال عمر بن الخطاب:" هو ما اردت"
A written message came to Sayyiduna Umar ibn Khattab (may Allah be pleased with him) that a man said to his wife: «حَبْلُكِ عَلَى غَارِبِكِ» . Sayyiduna Umar ibn Khattab (may Allah be pleased with him) wrote: Tell this man to meet me in Makkah during the Hajj season. Sayyiduna Umar ibn Khattab (may Allah be pleased with him) was performing Tawaf of the Ka'bah when a man met him and greeted him with salam. He asked: Who are you? He replied: I am the one whom you instructed to meet you in Makkah. Sayyiduna Umar ibn Khattab (may Allah be pleased with him) said: I swear by the Lord of this House, what did you mean by «حَبْلُكِ عَلَى غَارِبِكِ» ? He replied: O Commander of the Faithful! If you had made me swear anywhere else, I would not have told the truth, but now I will tell the truth: my intention was to leave her. Sayyiduna Umar ibn Khattab (may Allah be pleased with him) said: It will be as you intended.

Hadith Number: 1137
وحدثني، عن وحدثني، عن مالك، انه بلغه، ان علي بن ابي طالب، كان يقول في الرجل يقول لامراته انت علي حرام: " إنها ثلاث تطليقات" . قال مالك: وذلك احسن ما سمعت في ذلك
Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) used to say: Whoever says to his wife, "You are forbidden to me," three divorces will take place.
Imam Malik (may Allah have mercy on him) said: This narration is very good in my view.

Hadith Number: 1138
وحدثني، عن وحدثني، عن مالك، عن نافع ، ان عبد الله بن عمر ، كان يقول في الخلية والبرية: " إنها ثلاث تطليقات، كل واحدة منهما"
Sayyiduna Abdullah bin Umar (may Allah be pleased with them) used to say: In Khul‘ and Bari’ah, in each of them, three divorces will take effect.

Hadith Number: 1139
وحدثني، عن مالك، عن يحيى بن سعيد ، عن القاسم بن محمد ،" ان رجلا كانت تحته وليدة لقوم، فقال لاهلها: شانكم بها، فراى الناس انها تطليقة واحدة"
It is narrated from Hazrat Qasim bin Muhammad that a man had a slave-girl in his marriage. He said to the owners of the slave-girl: "You know, your matter knows." People considered this as one divorce.

Hadith Number: 1140
وحدثني، عن مالك، انه سمع ابن شهاب، يقول في الرجل يقول لامراته برئت مني وبرئت منك: " إنها ثلاث تطليقات، بمنزلة البتة" .
Ibn Shihab used to say: If a man says to a woman, "I am free from you and you are free from me," then three divorces will take place, like an irrevocable divorce.

قال مالك، في الرجل يقول لامراته انت خلية او برية او بائنة: إنها ثلاث تطليقات للمراة التي قد دخل بها، ويدين في التي لم يدخل بها، اواحدة اراد، ام ثلاثا؟ فإن قال واحدة، احلف على ذلك، وكان خاطبا من الخطاب، لانه لا يخلي المراة التي قد دخل بها زوجها، ولا يبينها ولا يبريها، إلا ثلاث تطليقات، والتي لم يدخل بها تخليها وتبريها، وتبينها الواحدة. قال مالك: وهذا احسن ما سمعت في ذلك
Imam Malik, may Allah have mercy on him, said: If a man says to his wife: "You are Khaliyyah (released)," or "Bariyyah (free)," or "Bainah (separated)," then if he has had intercourse with that woman, three divorces will take effect. And if he has not had intercourse, then it will be according to his intention. If he says: "I intended only one," then he will be considered truthful upon taking an oath. However, the woman will become separated (bain) with just one divorce, and he cannot take her back, but he can marry her again with a new contract, because a woman with whom intercourse has not taken place becomes separated (bain) with just one divorce, while the one with whom intercourse has taken place becomes separated (bain) with three divorces.
