كِتَابُ الْعِتْقِ وَالْوَلَاءِ
Book: On the Explanation of Emancipation and Allegiance
بَابُ مَنْ أَعْتَقَ رَقِيقًا لَا يَمْلِكُ مَالًا غَيْرَهُمْ
Chapter on one who frees slaves who own no property besides themselves
Hadith Number: 1269
حدثني مالك، عن يحيى بن سعيد ، وعن غير واحد، عن الحسن بن ابي الحسن البصري ، وعن محمد بن سيرين ، ان رجلا في زمان رسول الله صلى الله عليه وسلم اعتق عبيدا له ستة عند موته، " فاسهم رسول الله صلى الله عليه وسلم بينهم، فاعتق ثلث تلك العبيد" . قال مالك: وبلغني انه لم يكن لذلك الرجل مال غيرهم
It is narrated from Hasan al-Basri and Muhammad ibn Sirin that a man freed his six slaves during the time of the Messenger of Allah, peace and blessings be upon him. The Prophet, peace and blessings be upon him, drew lots and upheld the freedom of two of them.
Imam Malik, may Allah have mercy on him, said: It has reached me that this man had no wealth except for those six slaves.

Hadith Number: 1270
وحدثني مالك، عن ربيعة بن ابي عبد الرحمن ، ان رجلا في إمارة ابان بن عثمان" اعتق رقيقا له كلهم جميعا، ولم يكن له مال غيرهم، فامر ابان بن عثمان بتلك الرقيق، " فقسمت اثلاثا، ثم اسهم على ايهم يخرج سهم الميت فيعتقون، فوقع السهم على احد الاثلاث، فعتق الثلث الذي وقع عليه السهم"
It is narrated from Rabi'ah bin Abi Abdur Rahman that a man, during the caliphate of Aban bin Uthman, freed all his slaves, and besides those slaves, the man had no other wealth. So Aban bin Uthman ordered that the slaves be divided into three parts. Then, whichever part the deceased's share fell upon, those slaves were set free, and the parts that fell to the heirs, those slaves remained.
