بَابُ النَّهْيِ عَنْ أَنْ يَطَأَ الرَّجُلُ وَلِيدَةً وَلَهَا زَوْجٌ
Prohibition of a man having intercourse with a slave woman who has a husband
Hadith Number: 1309
حدثني حدثني يحيى، عن مالك، عن ابن شهاب ، ان عبد الله بن عامر اهدى لعثمان بن عفان جارية، ولها زوج ابتاعها بالبصرة، فقال عثمان : " لا اقربها حتى يفارقها زوجها"، فارضى ابن عامر زوجها، ففارقها
It is narrated from Ibn Shihab that Abdullah bin Umar (may Allah be pleased with them both) gifted a slave woman to Uthman bin Affan (may Allah be pleased with him), but she had a husband, and Abdullah bin Umar (may Allah be pleased with them both) had bought this slave woman in Basra. So Uthman bin Affan (may Allah be pleased with him) said: I will not have intercourse with this slave woman until her husband leaves her. Abdullah bin Umar (may Allah be pleased with them both) satisfied her husband, so he left her.

وحدثني، عن وحدثني، عن مالك، عن ابن شهاب ، عن ابي سلمة بن عبد الرحمن بن عوف ، ان عبد الرحمن بن عوف " ابتاع وليدة، فوجدها ذات زوج، فردها"
It is narrated from Abu Salamah bin Abdur Rahman that Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) bought a slave woman, and afterwards it became known that she had a husband, so he returned her.
