بَابُ مَا جَاءَ فِي بَيْعِ الْعَرِيَّةِ
What is reported about selling 'Ariyyah (a type of sale)
Hadith Number: 1316
حدثني يحيى، عن مالك، عن نافع ، عن عبد الله بن عمر ، عن زيد بن ثابت ، ان رسول الله صلى الله عليه وسلم " ارخص لصاحب العرية ان يبيعها بخرصها"
It is narrated from Sayyiduna Zaid bin Thabit (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) permitted the owner of ‘Ariyyah to sell his fruit by estimation.

وحدثني، عن مالك، عن داود بن الحصين ، عن ابي سفيان مولى ابن ابي احمد، عن ابي هريرة ، ان رسول الله صلى الله عليه وسلم " ارخص في بيع العرايا بخرصها فيما دون خمسة اوسق" . او في خمسة اوسق. يشك داود، قال: خمسة اوسق او دون خمسة اوسق.
It is narrated from Sayyiduna Abu Huraira, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, permitted the sale of 'ariyyah by estimation, provided it is less than five wasqs or up to five wasqs.

قال مالك: وإنما تباع العرايا بخرصها من التمر يتحرى ذلك، ويخرص في رءوس النخل، وإنما ارخص فيه لانه انزل بمنزلة التولية والإقالة والشرك، ولو كان بمنزلة غيره من البيوع ما اشرك احد احدا في طعامه حتى يقبضه المبتاع
Imam Malik, may Allah have mercy on him, said that the estimation of ‘Ariyyah will be made on the trees, and the Messenger of Allah, peace and blessings be upon him, permitted it. This is like musawamah (bargaining), iqalah (cancellation of sale), or partnership. If it were like other types of sales, then musawamah, iqalah, or partnership of food items before taking possession would not be valid, and this too would not be valid.
