Ruling on the testimony of one who has been punished

Hadith Number: 1417
قال يحيى: عن مالك انه بلغه، عن سليمان بن يسار ، وغيره، انهم سئلوا عن رجل جلد الحد، اتجوز شهادته؟ فقالوا:" نعم، إذا ظهرت منه التوبة"
Sulaiman bin Yasar and others were asked whether a person who has been subjected to the hadd punishment for qadhf, can his testimony be accepted? They replied: Yes, when he repents, and the truthfulness of his repentance becomes evident from his actions.

The same question was asked to Ibn Shihab, and he also said the same as Sulayman bin Yasar had said.

يسال عن ذلك، فقال مثل ما قال سليمان بن يسار. قال مالك: وذلك الامر عندنا، وذلك لقول الله تبارك وتعالى: والذين يرمون المحصنات ثم لم ياتوا باربعة شهداء فاجلدوهم ثمانين جلدة ولا تقبلوا لهم شهادة ابدا واولئك هم الفاسقون {4} إلا الذين تابوا من بعد ذلك واصلحوا فإن الله غفور رحيم سورة النور آية 4-5. قال مالك: فالامر الذي لا اختلاف فيه عندنا، ان الذي يجلد الحد ثم تاب واصلح تجوز شهادته، وهو احب ما سمعت إلي في ذلك.
Imam Malik, may Allah have mercy on him, said: In our view, this is the ruling, because Allah, the Glorious and Exalted, has said: "Those who accuse chaste women and then do not bring four witnesses, flog them with eighty (80) lashes, and never accept their testimony thereafter, for they are the wicked. Except for those who repent after that and reform, for surely Allah is Forgiving, Merciful." Imam Malik, may Allah have mercy on him, said: So, whoever has had the hadd of qadhf applied to him, then repents and reforms, his testimony is valid.
