The Book of Tricks
بَابُ إِذَا غَصَبَ جَارِيَةً فَزَعَمَ أَنَّهَا مَاتَتْ:
Chapter. If somebody kidnaps a slave-girl and then claims that she is dead.

ثم وجدها صاحبها فهي له ويرد القيمة ولا تكون القيمة ثمنا، وقال بعض الناس الجارية للغاصب لاخذه القيمة وفي هذا احتيال لمن اشتهى جارية رجل لا يبيعها فغصبها واعتل بانها ماتت حتى ياخذ ربها قيمتها فيطيب للغاصب جارية غيره، قال النبي صلى الله عليه وسلم اموالكم عليكم حرام ولكل غادر لواء يوم القيامة.
Now, if the owner of the slave-girl made a claim over her, and the usurper said that the slave-girl had died, the ruler made him pay the price. After this, if the owner found his slave-girl alive, he will take back his slave-girl and return the price that the usurper had paid. It will not be that the price paid by the usurper becomes the purchase price of the slave-girl, making her the property of the usurper. Some people have said that the slave-girl becomes the property of the usurper because the owner has already taken her price from him. This verdict has been given as if it is a way for a person to obtain any slave-girl he desires: he can forcibly seize anyone’s slave-girl, and when the owner makes a claim, he will say she has died and pay the owner her price. After that, he will enjoy someone else’s slave-girl without worry, because in his false belief, the slave-girl has become lawful for him. However, the Prophet (peace and blessings be upon him) said:“The wealth of one another is forbidden for you,”and he said:“On the Day of Resurrection, a flag will be raised for every deceiver (so that everyone will know about his deceit).”

حدثنا ابو نعيم، حدثنا سفيان، عن عبد الله بن دينار، عن عبد الله بن عمر رضي الله عنهما، عن النبي صلى الله عليه وسلم، قال:" لكل غادر لواء يوم القيامة يعرف به".
Narrated `Abdullah bin `Umar: The Prophet said, "For every betrayer there will be a flag by which he will be recognized on the Day of Resurrection. "
