95 Subchapter: Permissibility of entering ihram without specifying Hajj or Umrah, or intending one in particular
Hadith Number: 2620
Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) narrates that we set out with the Messenger of Allah (peace be upon him) from Madinah Munawwarah with the intention of Hajj only, until the Messenger of Allah (peace be upon him) reached Makkah Mukarramah. He performed seven circuits (Tawaf) of the House (Ka'bah) and offered two rak'ahs near Maqam Ibrahim. Then the Messenger of Allah (peace be upon him) said: "We will begin (Sa'i) from the place from which Allah has begun (in the Qur'an)." Therefore, he started (Sa'i) from the hill of Safa, until the seventh and last circuit ended at the hill of Marwah and he completed the Sa'i. Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) arrived from Yemen bringing animals for sacrifice for the Prophet (peace be upon him). The Messenger of Allah (peace be upon him) asked: "With what intention did you enter Ihram (what Talbiyah did you recite)?" He replied: "I said, O Allah, I enter Ihram with the same intention as Your Messenger entered Ihram." The Prophet (peace be upon him) said: "Indeed, I have entered Ihram for Hajj." Then Janab Duraqi narrated the rest of the hadith. Imam Abu Bakr (may Allah have mercy on him) says that Sayyiduna Ali (may Allah be pleased with him) entered Ihram in the same way as the Prophet (peace be upon him), even though at the time of entering Ihram, Sayyiduna Ali (may Allah be pleased with him) did not know for which type of Hajj the Prophet (peace be upon him) had entered Ihram. This is because the Prophet (peace be upon him) had entered Ihram at the Miqat of Dhul-Hulaifah on the way from Madinah Munawwarah, while Sayyiduna Ali (may Allah be pleased with him) was at that time in the direction of Yemen, and he only found out upon reaching Makkah Mukarramah from the Prophet (peace be upon him) for which type of Hajj he had entered Ihram. However, the Prophet (peace be upon him) approved the Ihram of Sayyiduna Ali (may Allah be pleased with him), which he had entered with the intention of following the Prophet (peace be upon him), even though at the time of entering Ihram he did not know whether the Prophet (peace be upon him) had entered Ihram for Hajj, Umrah, or both. The story of Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him) is also related to this issue. When he came to the Prophet (peace be upon him) while he was staying at Batha, the Prophet (peace be upon him) said to him: "You have done well (by not bringing your sacrificial animal with you, so perform Umrah and come out of Ihram)." But in the end, the Prophet (peace be upon him) gave Sayyiduna Ali (may Allah be pleased with him) a different ruling than Sayyiduna Abu Musa (may Allah be pleased with him). The Prophet (peace be upon him) instructed Sayyiduna Ali (may Allah be pleased with him) to remain in Ihram because he had the sacrificial animal with him, so he was not permitted to come out of Ihram until the sacrificial animal reached its place (on the 10th of Dhul-Hijjah). And he instructed Sayyiduna Abu Musa (may Allah be pleased with him) to perform Umrah and come out of Ihram because he did not have a sacrificial animal with him. I have explained this issue in Kitab al-Kabir.
