أَبْوَابُ أَحْكَامِ الْعُيُوبِ
Chapters on Rulings of Defects
بَاب مَا جَاءَ فِي عُهْدَةِ الرَّقِيقِ وَأَنَّ الكَسْبَ الْحَادِثَ لا يمنعُ الرَّدْ بِالْعَيْبِ
Chapter: What has been reported regarding the guarantee of slaves and that new earnings do not prevent return due to defect
Hadith Number: 5938
عن عائشة رضي الله عنها ان رجلا ابتاع غلاما استغله ثم وجد او راى به عيبا فرده بالعيب فقال البائع غلة عبدي فقال النبي صلى الله عليه وآله وسلم الغلة بالضمان وفي لفظ الخراج بالضمان
It is narrated from Sayyidah Aisha (may Allah be pleased with her) that a man bought a slave and benefited from him, but later he found a defect in him and returned him. The seller said: The earnings of my slave (should also be given to me). The Prophet (peace and blessings be upon him) said: The earnings (and profit) are in exchange for the guarantee.

Hadith Number: 5939
عن قتادة عن الحسن عن عقبة بن عامر رضي الله عنه ان رسول الله صلى الله عليه وآله وسلم قال عهدة الرقيق اربع ليال قال قتادة واهل المدينة يقولون ثلاث ليال
Narrated by Sayyiduna Uqbah bin Amir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: The responsibility of a slave is for four nights. Whereas Qatadah says: According to the people of Madinah, it is three nights.

Hadith Number: 5940
عن يونس عن الحسن عن عقبة بن عامر رضي الله عنه قال قال رسول الله صلى الله عليه وآله وسلم لا عهدة بعد اربع
Narrated by Sayyiduna Uqbah bin Amir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: After four days, there is no responsibility (regarding the slave).
