Issues of Preemption
بَابُ فِي أَيِّ شَيْءٍ تَكُونُ الشُّفْعَةُ وَلِمَنْ تَكُونُ
Chapter: In what cases is pre-emption established and for whom
Hadith Number: 6223
عن جابر بن عبد الله رضي الله عنهما قال قال رسول الله صلى الله عليه وآله وسلم الشفعة في كل شرك ربعة او حائط لا يصلح له ان يبيع حتى يؤذن شريكه فإن باع فهو احق به حتى يؤذنه
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: There is pre-emption (shuf‘a) in every jointly owned thing, whether it is a house or a garden. It is not permissible for one partner to sell such a thing until he informs his partner about it. If he sells it without informing his partner, then the partner has more right to it, until he is informed.

Hadith Number: 6224
عن عبادة بن الصامت رضي الله عنه قال قضى رسول الله صلى الله عليه وآله وسلم بالشفعة بين الشركاء في الارضين والدور
It is narrated from Sayyiduna Ubadah bin Samit (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) decreed the right of pre-emption among partners in land and houses.

Hadith Number: 6225
عن سمرة بن جندب رضي الله عنه قال قال رسول الله صلى الله عليه وآله وسلم جار الدار احق بالدار من غيره
Narrated by Sayyiduna Samurah bin Janab (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: The neighbor of the house has more right to buy the house than others.

Hadith Number: 6226
عن جابر بن عبد الله رضي الله عنهما قال قال رسول الله صلى الله عليه وآله وسلم الجار احق بشفعة جاره ينتظر بها وإن كان غائبا إن كان طريقهما واحدا
Narrated by Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: The neighbor has more right to the pre-emption (the share being sold) of his neighbor; if he is absent, he should be waited for, but this greater right will be when their path is one.

Hadith Number: 6227
عن الشريد بن سويد الثقفي رضي الله عنه ان النبي صلى الله عليه وآله وسلم قال جار الدار احق بالدار من غيره
Narrated by Sayyiduna Shureid bin Suwaid Thaqafi (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: The neighbor of the house has more right to the house than others.

Hadith Number: 6228
عن الحكم عمن سمع عليا وابن مسعود رضي الله عنهما يقولان قضى رسول الله صلى الله عليه وآله وسلم بالجوار
It is narrated from Sayyiduna Ali and Abdullah bin Mas'ud (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) gave judgment on the basis of the right of the neighbor.

Hadith Number: 6229
عن عمرو بن الشريد عن ابيه الشريد بن سويد رضي الله عنه قال قلت يا رسول الله ارض ليس لاحد فيها شرك ولا قسم إلا الجوار قال الجار احق بسقبه ما كان
It is narrated from Sayyiduna Shureid bin Suwaid, may Allah be pleased with him, he says: O Messenger of Allah! There is a piece of land in which there is neither any partnership nor any share of anyone, except that there is only a neighbor? You (peace and blessings be upon him) said: The neighbor has more right because of being close, whatever the thing may be.

Hadith Number: 6230
عن عمرو بن الشريد عن ابيه الشريد بن سويد رضي الله عنه قال قلت يا رسول الله ارض ليس لاحد فيها شرك ولا قسم إلا الجوار قال الجار احق بسقبه ما كان
It is narrated from Sayyiduna Abu Rafi’ (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him and his family) said: The neighbor, due to his closeness, has more right to purchase a thing.
