Chapter: Is the Hadd of Cutting and Others Carried Out in the Land of War or Not?
Hadith Number: 6767
Janadah bin Abi Umayyah enforced the hadd punishment on those two men on the island of Rhodes who had stolen from the spoils of war, and then ascended the pulpit and said: I did not cut off their hands because I heard from Sayyiduna Busar bin Arta’ah (may Allah be pleased with him), who found a man named Masdar in a state where he had stolen during a military expedition, so he flogged him but did not cut off his hand. He also said: The Noble Prophet (peace and blessings be upon him) has forbidden us from cutting off the hand during a military expedition.

(Second chain) He says: I was with Sayyiduna Busar bin Artaat (may Allah be pleased with him), a thief was brought to him who had stolen a Bactrian camel. Sayyiduna Busar (may Allah be pleased with him) said: If I had not heard the Noble Prophet (peace and blessings be upon him) forbidding the cutting of the hand during a military expedition, I would have cut off your hand.

It is narrated from Sayyiduna ‘Ubada bin Samit (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: Strive (do jihad) for the sake of Allah against those who are near and those who are far, and do not care about the blame of any blamer for the sake of Allah, and establish the limits set by Allah in residence and on journey.
