كِتَابُ التَّفْسِيرِ
Book of Tafsir (Quranic Exegesis)
قَوْلُهُ تَعَالَى: {وَإِنْ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ وَقَدْ فَرَضْتُمْ لَهُنَّ فَرِيضَةً فَنِصْفُ مَا فَرَضْتُمْ إِلا أَنْ يَعْفُونَ أَوْ يَعْفُوَ الَّذِي بِيَدِهِ عُقْدَةُ النِّكَاحِ وَأَنْ تَعْفُوا أَقْرَبُ لِلتَّقْوَى}
His saying, Exalted is He: {And if you divorce them before you have touched them and you have already specified for them an obligation, then [give] half of what you specified—unless they forgo the right or the one in whose hand is the marriage contract forgoes it. And to forgo it is nearer to righteousness.}
Hadith Number: 385
نا ابو الاحوص ، عن ابي إسحاق ، قال: كان شريح , يقول: " الذي بيده عقدة النكاح سورة البقرة آية 237: الزوج" ,
Shurayh (may Allah have mercy on him) used to say: The authority of marriage is in the hands of the husband.

نا ابو عوانة ، عن ابي بشر ، عن طاوس ، وعطاء ، واهل المدينة، انهم قالوا: " الذي بيده عقدة النكاح هو الولي"، فاخبرتهم بقول سعيد بن جبير:" هو الزوج"، فرجعوا عن قولهم، فلما قدم سعيد بن جبير , قال:" ارايتم إن عفا الولي، وابت المراة، ما يعني عفو الولي او عفت هي، وابى الولي، ما للولي من ذلك؟" .
Tawoos (may Allah have mercy on him), Ata (may Allah have mercy on him), and the people of Madinah said: "The one who holds the knot of marriage is the guardian (wali)." When they were informed of the statement of Sa'eed bin Jubair (may Allah have mercy on him) that "this is the husband," they retracted their statement. Then when Sa'eed bin Jubair (may Allah have mercy on him) arrived, he said: "If the guardian forgives and the woman refuses, then what is the meaning of the guardian's forgiveness? Or if the woman forgives and the guardian refuses, then what right does the guardian have in this matter?"

Hadith Number: 389
نا سفيان ، عن عمرو بن دينار ، عن عكرمة , قال: " امر الله عز وجل بالعفو، واذن فيه، فإن عفت جاز عفوها، وإن شحت، وعفا وليها، جاز عفوه" .
Ikrimah (may Allah have mercy on him) said: "Allah, the Mighty and Majestic, has commanded forgiveness and permitted it. So if the woman forgives, her forgiveness is valid, and if she withholds and her guardian forgives, then his forgiveness is also valid."

Hadith Number: 390
نا جرير ، عن مغيرة ، عن الشعبي ، قال: تزوج رجل منا امراة فطلقها زوجها قبل ان يدخل بها، فعفا اخوها عن صداقها، فارتفعوا إلى شريح فاجاز عفوه، ثم قال بعد: " انا اعفو عن صداق بني مرة، فكان يقول بعد: الذي بيده عقدة النكاح الزوج، ان يعفو عن الصداق كله، فيسلمه لها، او تعفو هي عن النصف الذي فرض الله عز وجل لها، وإن تشاحا، فلها نصف الصداق" .
Shu’bi (may Allah have mercy on him) said:“One of us married a woman, then her husband divorced her before being alone with her, so her brother forgave her dowry. So they went to Shurayh (may Allah have mercy on him), and he considered his forgiveness valid. Then later he said: I forgive the dowry of Banu Murrah. After that, he used to say: ‘The one in whose hand is the knot of marriage’ refers to the husband, that he may forgive the entire dowry and give it to the woman, or the woman may forgive the half of the dowry which Allah, the Mighty and Majestic, has prescribed for her. And if there is a dispute between the two, then the woman will receive half the dowry.”

Hadith Number: 391
نا جرير ، عن مغيرة ، عن الشعبي ، قال:" والله ما قضى شريح بقضاء قط، كان احمق منه، حين ترك قوله الاول واخذ بهذا" .
Shu'bi (may Allah have mercy on him) said: "By Allah! Shurayh (may Allah have mercy on him) never made a decision more inappropriate than when he abandoned his first statement and adopted this second opinion."
