كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ الرَّجُلِ يَقُولُ لِامْرَأَتِهِ: قَدْ وَهَبْتُكِ لِأَهْلِكِ
Chapter on a man saying to his wife: I have given you to your family
Hadith Number: 1596
نا هشيم، قال: انا ابو حرة، ومنصور، عن الحسن، قال: " إذا وهبتها لاهلها، فقبلوها فهي ثلاث، وإن ردوها فواحدة، وهو احق بها" .
Hasan (may Allah have mercy on him) said: If a man hands over his wife to her family and they accept her, then three divorces will take place, and if they return her, then one divorce will occur and the man will have more right to her.

Hadith Number: 1597
حدثنا حدثنا هشيم، انا مطر، عن الحكم، عن يحيى بن الجزار، عن علي رضي الله عنه , انه كان يقول: " إن قبلوها فهي واحدة بائنة، وإن ردوها فهي واحدة، وهو احق بها" .
Sayyiduna Ali (may Allah be pleased with him) said: If the household accepts, then it is one irrevocable divorce (ba’inah), and if they return it, then it will be one revocable divorce (raj’i), and the husband will have more right to her.

Hadith Number: 1598
حدثنا حدثنا هشيم، انا اشعث، عن الشعبي، عن مسروق، عن عبد الله ، قال: " إن قبلوها فواحدة، وإن لم يقبلوها فلا شيء" .
It is narrated from Sayyiduna Abdullah (may Allah be pleased with him) that if the wife is accepted by the family members, then one divorce will take place, and if they do not accept her, then nothing will happen.

Hadith Number: 1599
حدثنا معتمر بن سليمان، عن منصور، عن إبراهيم، قال: " كان يقال في الموهوبة لاهلها: تطليقة" . قال قال منصور: بلغني عن ابن مسعود , انه كان يقول: " إن قبلوها فواحدة، وإن لم يقبلوها فلا شيء" .
Ibrahim (may Allah have mercy on him) said: When the wife is handed over to her family, one divorce takes place. Sayyiduna Ibn Mas'ud (may Allah be pleased with him) said: If they accept, then one divorce; and if they do not accept, then nothing.

Hadith Number: 1600
نا إسماعيل بن عياش، عن عبيد الله بن عبيد الكلاعي، عن مكحول، قال: " إن قبلوها فهي تطليقة، وهو املك بها، وإن لم يقبلوها، فلا شيء" .
Hazrat Mak'hool (may Allah have mercy on him) said: If the household accepts, then one divorce will take place and the husband will have more right to her, and if they do not accept, then nothing will happen.

نا إسماعيل بن عياش، عن عبد العزيز بن عبيد الله، عن الشعبي، عن مسروق، مثل ذلك.
It is narrated in the same manner from Hazrat Masruq (may Allah have mercy on him).

نا ابو عوانة، عن منصور، عن إبراهيم، في الرجل يقول لامراته: قد وهبتك لاهلك , قال:" كانوا يقولون: هي تطليقة، ولا يدري ابائنة ام يملك الرجعة" .
It is narrated from Ibrahim (may Allah have mercy on him) that when a man says to his wife: "I have given you to your family," they used to say: This is one divorce, but it is not known whether it is irrevocable (bainah) or revocable (raj‘i).
