بَابُ الْأَمَةِ تُبَاعُ وَلَهَا زَوْجٌ
Chapter on a slave woman being sold while she has a husband
Hadith Number: 1941
نا نا ابو الاحوص، عن ابي إسحاق الهمداني، عن الشعبي، قال: كان عبد الله ، يقول: " بيع الامة طلاقها" .
Sayyiduna Abdullah (may Allah be pleased with him) used to say: "Selling a slave woman is her divorce."

نا نا هشيم، قال: انا مغيرة، عن إبراهيم، ان ابن مسعود ، قال: " بيع الامة طلاقها" .
Sayyiduna Ibn Mas'ud (may Allah be pleased with him) said: "Selling a slave woman is her divorce."

نا نا هشيم، قال: انا يونس، عن الحسن، عن ابي بن كعب ، انه قال: " بيع الامة طلاقها" .
Sayyiduna Ubayy bin Ka'b (may Allah be pleased with him) said: "Selling a slave woman is her divorce."

Hadith Number: 1944
نا حماد بن زيد، عن يحيى بن سعيد، عن سعيد بن المسيب، قال: " إذا تزوج العبد بإذن سيده، ثم باعه فإنه لا يحال بينه وبينها، وإذا زوج الرجل امته ثم باعها، فإنه كان يرى بيعها طلاقها" .
Hazrat Saeed bin Musayyib (may Allah have mercy on him) said: "If a slave marries with the permission of his master, then he is sold, his marriage will remain intact. But if someone marries off his slave-girl and then sells her, the selling of the slave-girl was considered her divorce."

نا هشيم، قال: انا يحيى بن سعيد، عن سعيد بن المسيب، قال: " بيع الامة طلاق، وبيع العبد ليس بطلاق" .
Hazrat Saeed bin Musayyib (may Allah have mercy on him) said: "Selling a female slave is divorce, and selling a male slave is not divorce."

نا هشيم، قال: انا منصور، عن الحسن، قال: " بيع الامة طلاقها" .
Hasan (may Allah have mercy on him) said: "Selling a slave woman is her divorce."

نا نا هشيم، قال: انا خالد الحذاء، عن عكرمة، عن ابن عباس ، انه كان يقول في بيع الامة:" فهو طلاقها" .
Ibn Abbas (may Allah be pleased with them) said: "Selling a slave woman is her divorce."

نا هشيم، قال: انا منصور، عن الحسن، انه كان يقول: " إباق العبد طلاقه" .
Hasan (may Allah have mercy on him) said: "The escape of a slave is his divorce."

نا نا ابو الاحوص، قال: انا عاصم الاحول، عن الشعبي، قال: اهدي لعلي رضي الله عنه جارية فانبئ ان لها زوجا،" فاشترى بضعها من زوجها بخمس مائة درهم على ان يطلقها" .
A slave woman was given as a gift to Sayyiduna Ali (may Allah be pleased with him). When he was informed that she had a husband, he bought her marital rights from her husband for five hundred dirhams so that he would divorce her.

Hadith Number: 1950
نا نا هشيم، قال: انا داود بن ابي هند، وعبيدة، عن الشعبي، ان مرة بن شراحيل، صاحب السيلحين، بعث إلى علي رضي الله عنه بجارية، فسالها:" هل لك من زوج؟" قالت: نعم، فردها، وكتب إلى مرة" إني وجدت هديتك مشغولة"، فاشترى مرة بضعها من زوجها بخمس مائة درهم، وبعث بها إليه فقبلها .
Marrah bin Shurahil sent a slave woman to Sayyiduna Ali (may Allah be pleased with him). When he asked her, "Do you have a husband?" she replied, "Yes." So he returned her and wrote: "I found the slave woman you gifted to be engaged (i.e., married)." Then Marrah bought her private part (i.e., her marital rights) from her husband and sent her again to his service, so he accepted her.
