Ibn Sirin (may Allah have mercy on him) narrates that Sayyiduna Bara’ bin Malik (may Allah be pleased with him) confronted the marzban of Za’rah in Bahrain, struck him with a spear, broke his back, and killed him. Then he took his horse and the spoils of war. When Sayyiduna Umar bin Khattab (may Allah be pleased with him) had performed the Zuhr prayer, he went to the house of Sayyiduna Abu Talhah (may Allah be pleased with him) and said:“We did not use to take out a fifth (khums) from the spoils, but the spoils of Bara’ are so valuable that I am taking out a fifth from it.”Thus, in Islam, the spoils of Bara’ (may Allah be pleased with him) were the first to have a fifth taken from them.

Umar bin Abdul Aziz, may Allah have mercy on him, ordered that the Coptic slaves who escaped from the captivity of the polytheists and came to Beirut by ship should be given that ship and the goods and belongings present in it as a reward, except for the khums (one-fifth).

Sayyiduna Ma'n bin Yazid (may Allah be pleased with him) says: I, my father, and my grandfather—all three of us pledged allegiance to the Messenger of Allah (peace and blessings be upon him). I brought a case before him, and he judged in my favor, and he also arranged my marriage. Then he said: "Spoils of war and voluntary gifts are not lawful until they are distributed equally among everyone."
