باب إعتاق الشريك - ذكر البيان بأن المعتق نصيبه من مملوكه إذا كان معدما كان نصيبه الذي أعتق جائزا عتقه-
Chapter on Emancipating a Partner’s Share – Clarification that freeing one’s share is valid even if the owner is poor
Hadith Number: 4316
اخبرنا الحسين بن إدريس الانصاري ، اخبرنا احمد بن ابي بكر ، عن مالك ، عن نافع ، عن ابن عمر ، ان رسول الله صلى الله عليه وسلم، قال: " من اعتق شركا له في عبد، فكان له مال يبلغ ثمن العبد، قوم عليه قيمة العدل، واعطى شركاءه حصصهم، واعتق عليه العبد، وإلا فقد عتق منه ما عتق" .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them) narrates: The Prophet Muhammad (peace and blessings be upon him) said, "Whoever frees his share in a slave, and he possesses enough wealth to cover the full price of the slave, then the slave will be appraised fairly, and that person will pay his partners their share, and the slave will be freed on his behalf. Otherwise, only the portion that he has freed will be free."
