باب حد القذف - ذكر البيان بأن القاذف امرأته عند عدم الشهود الأربعة بقذفه إياها أو تلكئه عن اللعان يجب عليه الحد لقذفه امرأته-

Hadith Number: 4451
اخبرنا احمد بن علي بن المثنى ، قال: حدثنا مسلم بن ابي مسلم الجرمي ، قال: حدثنا مخلد بن الحسين ، عن هشام بن حسان ، عن ابن سيرين ، عن انس بن مالك ، قال: اول لعان في الإسلام ان شريك بن سحماء اقذفه هلال بن امية بامراته، فرفعه إلى النبي صلى الله عليه وسلم، فقال النبي صلى الله عليه وسلم:" يا هلال، اربعة شهود وإلا فحد في ظهرك". قال: يا رسول الله، إن الله يعلم اني صادق، ولينزلن الله عليك ما يبرئ ظهري من الجلد، فانزل الله: والذين يرمون ازواجهم سورة النور آية 6 إلى آخر الآية، فدعاه النبي صلى الله عليه وسلم، فقال: " اشهد بالله إنك لمن الصادقين فيما رميتها به من الزنى". فشهد بذلك اربع شهادات، ثم قال له في الخامسة:" ولعنة الله عليك إن كنت من الكاذبين فيما رميتها به من الزنى". ففعل، ثم دعاها رسول الله صلى الله عليه وسلم، فقال:" قومي اشهدي بالله إنه لمن الكاذبين فيما رماك به من الزنى". فشهدت بذلك اربع شهادات، ثم قال لها في الخامسة:" وغضب الله عليك إن كان من الصادقين فيما رماك به من الزنى". فلما كان في الرابعة او الخامسة فسكتت سكتة حتى ظنوا انها ستعترف، ثم قالت: لا افضح قومي سائر اليوم، فمضت على القول، ففرق رسول الله صلى الله عليه وسلم بينهما، وقال:" انظروا، إن جاءت به جعدا حمش الساقين فهو لشريك بن سحماء، وإن جاءت به ابيض سبطا قضيء العينين فهو لهلال بن امية". فجاءت به آدم جعدا حمش الساقين، فقال رسول الله صلى الله عليه وسلم:" لولا ما نزل فيهما من كتاب الله لكان لي ولهما شان" .
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates: The incident of li'an (mutual cursing) occurred for the first time in Islam when Hilal bin Umayyah accused Sharik bin Sahma of committing adultery with his wife. He presented this case before the Prophet Muhammad (peace and blessings be upon him), so the Prophet (peace and blessings be upon him) said: "Hilal, bring four witnesses, otherwise the legal punishment will be carried out on your back." He said: "O Messenger of Allah (peace and blessings be upon him)! Allah knows that I am truthful, and Allah will surely reveal something to you that will prevent lashes from being inflicted on my back." Then Allah revealed this verse: "Those who accuse their wives..." until the end of the verse. So the Prophet (peace and blessings be upon him) called them and said: "Testify by the name of Allah that you are truthful regarding the accusation of adultery you have made against this woman." So he testified to this four times. Then, on the fifth time, the Prophet (peace and blessings be upon him) said to him: "(Say) May the curse of Allah be upon me if I am lying regarding what I have accused this woman of." So he did so. Then the Prophet (peace and blessings be upon him) called the woman and said: "Stand up and testify by the name of Allah that this man is lying regarding what he has accused you of." So the woman testified to this four times. On the fifth time, the Prophet (peace and blessings be upon him) said to the woman: "(Say) May the wrath of Allah be upon me if he is truthful regarding what he has accused you of." On the fourth or fifth time, the woman paused for a while, to the extent that people thought she would confess. Then the woman said: "I will not disgrace my people," and she continued her testimony. So the Prophet (peace and blessings be upon him) separated the two spouses and then said: "You people should observe: if she gives birth to a child with curly hair and thick shins, then he will be Sharik bin Sahma's; if she gives birth to a child with fair complexion, straight hair, and large eyes, then he will be Hilal bin Umayyah's." The narrator says: The woman gave birth to a wheat-colored child with curly hair and thick shins. So the Prophet (peace and blessings be upon him) said: "If the command of Allah's Book had not already been revealed regarding both of them, I would have dealt with this matter differently."
