فصل في التعذيب - ذكر خبر أوهم عالما من الناس أن عروة لم يسمع هذا الخبر من هشام بن حكيم بن حزام-
Section on Torture – On a narration that led a scholar to think ‘Urwah did not hear this from Hisham ibn Hakim
Hadith Number: 5613
اخبرنا ابو يعلى ، قال: حدثنا عبد الاعلى بن حماد ، قال: حدثنا حماد بن سلمة ، عن هشام بن عروة ، عن عروة ، ان حكيم بن حزام ، مر بعمير بن سعد وهو يعذب الناس في الجزية في الشمس، فقال: يا عمير، إني سمعت رسول الله صلى الله عليه وسلم، يقول:" إن الله يعذب الذين يعذبون الناس في الدنيا" ، قال: اذهب، فخل سبيلهم، قال ابو حاتم: سمع هذا الخبر عروة، عن هشام بن حكيم بن حزام، وهو يعاتب عياض بن غنم على هذا الفعل، وسمعه ايضا من حكيم بن حزام حيث عاتب عمير بن سعد على هذا الفعل سواء، فالطريقان جميعا محفوظان.
Urwah narrates: Sayyiduna Hakim bin Hizam (may Allah be pleased with him) passed by Umair bin Sa’d, who was punishing people by making them stand in the sun because of jizyah. Sayyiduna Hakim bin Hizam said: O Umair, I heard the Prophet (peace and blessings of Allah be upon him) say:“Indeed, Allah will punish those who punish people in this world.”Sayyiduna Hakim said: Go and release them.
(Imam Ibn Hibban, may Allah have mercy on him, says:) Urwah heard this narration from Hisham bin Hakim, who was rebuking Iyad bin Ghanm for doing such a thing, and he also heard this narration from Sayyiduna Hakim bin Hizam (may Allah be pleased with him), who rebuked Umair bin Sa’d for doing such a thing. So both of these chains are preserved.
