Imam Malik, may Allah have mercy on him, said that it is not permissible to sell a mudabbar, nor is it permissible for anyone to buy him, except that the mudabbar can purchase himself from his master; this is permissible. And it is also permissible that a person gives some wealth to the master of the mudabbar so that he may free his mudabbar, but the wala’ will go to the master who made him a mudabbar.

Imam Malik, may Allah have mercy on him, said that it is not permissible to sell the service of a mudabbar slave, because there is deception in it; it is not known how long the master will live, and for this reason, the sale of the service remains unknown. And according to Imam Abu Hanifa, may Allah have mercy on him, the sale of the service of a mudabbar slave is permissible, because Darqutni has narrated with a marfu’ chain that the Messenger of Allah, peace and blessings be upon him, sold the service of a mudabbar slave, but the hadith is weak both in mursal and musnad forms.

Imam Malik, may Allah have mercy on him, said that if a slave is jointly owned by two people and one of them declares his share as Mudabbar, then the value of the slave will be assessed. If the person who made the Mudabbar declaration buys the other partner's share as well, then the entire slave will become Mudabbar. If he does not buy it, then his declaration of Mudabbar will become void, except in the case where the one who did not make the Mudabbar declaration agrees to take the price from his partner, and takes the price, then the slave will become Mudabbar.

Imam Malik, may Allah have mercy on him, said that if a Christian makes his Christian slave a mudabbar, and afterwards the slave becomes Muslim, then he will be separated from the mawla, meaning he will not remain in the service of the mawla, because it is not appropriate for a Muslim to serve a disbeliever, so he will be separated from the mawla. And on behalf of the mawla, a certain amount will be fixed upon the slave in exchange for service, which he will pay to the mawla, but he will not be sold until the condition of the mawla is known. If the Christian mawla dies in debt, then the mudabbar will be sold and his debt will be paid, but if there is enough wealth that after paying the debt something remains, then whatever remains after the debt, the mudabbar will be freed from that one-third.

Umar bin Abdul Aziz ordered that when a mudabbar slave injures someone, the master should hand over the mudabbar to the injured person, who may take service from him in exchange for the compensation for his wound. When the compensation is paid off and the master has not died, then the slave should return to his master.

Imam Malik, may Allah have mercy on him, said: According to us, the ruling is that if a mudabbar (a slave set free after the master's death) injures someone, then the master dies and there is no other wealth except the mudabbar, one third of the mudabbar will be set free. Then the blood money (diyah) for the wound will be divided into three parts: one part will be assigned to the one third of the mudabbar that has been set free, and two parts will be assigned to the two thirds that are in the hands of the heirs. Now the heirs have the choice: if they wish, they may hand over these two thirds also to the injured party of the mudabbar, or if they wish, they may pay two thirds of the diyah and keep the two thirds of the mudabbar, because the diyah for this wound is due to the crime of the slave, and there is no debt upon the master, so the act done by the master due to the slave’s fault—freedom or tadbeer—will not be invalidated. If, in this situation, the master is also in debt, then from the mudabbar, in accordance with the diyah and the debt, first the diyah will be paid, then the debt will be paid, then whatever part of the slave remains, one third of it will be set free and two thirds will go to his heirs, because the compensation for the slave’s crime takes precedence over the master’s debt. Its example is this: A person dies and leaves behind a mudabbar slave whose value is one hundred and fifty dinars, and this slave had injured someone for whom the diyah for the wound is fifty dinars, and the master also has a debt of fifty dinars. So first, from the value of the mudabbar, fifty dinars for the diyah will be paid, then fifty dinars for the debt will be paid, then whatever remains, one third of it will be set free and two thirds will go to the heirs. Thus, the diyah takes precedence over the debt, and the debt takes precedence over the tadbeer, and as for the will (wasiyyah) in one third of the wealth, the tadbeer will not be valid when the master has a debt, whatever it may be, rather tadbeer is a kind of will, and Allah the Exalted says: «﴿مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ﴾ [النساء: 12] » and the debt takes precedence over the will in general.

Imam Malik, may Allah have mercy on him, said that if a mudabbar can be freed from one-third of the wealth, then he will be freed, and the blood money for the wound will remain as a debt upon him even if it is the full blood money. After his freedom, he will be held accountable for it when the master has no debt upon him.

Imam Malik, may Allah have mercy on him, said that if a mudabbar (a slave set free after the master's death) injures someone and the master hands him over to the injured party, then the master dies in debt and leaves nothing except the mudabbar, and the heirs say, "We hand over the mudabbar to the injured party," and the creditor says, "If the mudabbar is given to me, I will pay more than the blood money," then in this case the mudabbar will be handed over to the creditor, and the amount by which the creditor pays more than the blood money will be deducted from the master's debt. If the creditor does not pay more than the blood money, then he cannot take the mudabbar.

Imam Malik, may Allah have mercy on him, said that if a mudabbar (a slave set free after the death of his master) is wealthy and injures someone, and then the master refuses to pay the blood money (diyah), the injured person will take the mudabbar's property as compensation for his diyah. If the diyah is fully paid from this property, the mudabbar will be handed over to his master; otherwise, the remaining amount of diyah will be compensated by taking service from the mudabbar equivalent to the outstanding amount.

Imam Malik, may Allah have mercy on him, said that if an umm walad injures someone, the blood money must be given by her master, except in the case where the blood money exceeds the value of the umm walad. In such a case, it is not obligatory for the master to hand over the slave woman or slave to the victim of the crime, even if the blood money is more than the value of the slave woman or slave. Here, the master of the umm walad cannot hand over the umm walad to the victim of the crime, because the sale, gift, or any kind of transfer of ownership of the umm walad is not permissible; rather, it is against the ancient Sunnah. Therefore, the value of the umm walad itself stands in place of the umm walad, and the master is not obliged to pay more than that. I have heard very well that it is not obligatory for the master to pay more than the value of the umm walad in the case of a crime.
