بَابُ مَا جَاءَ فِي حَدِّ الْخَمْرِ
Chapter on what is reported regarding the punishment for wine
Hadith Number: 1578
وحدثني، عن وحدثني، عن مالك، عن ابن شهاب ، عن السائب بن يزيد انه اخبره، ان عمر بن الخطاب خرج عليهم، فقال:" إني وجدت من فلان ريح شراب، فزعم انه شراب الطلاء، وانا سائل عما شرب، فإن كان يسكر جلدته". فجلده عمر الحد تاما
It is narrated from Sayyiduna Sa’ib bin Yazid (may Allah be pleased with him) that Sayyiduna Umar bin Khattab (may Allah be pleased with him) went out and said: I found the smell of wine from so-and-so (Ubaydullah, the son of Sayyiduna Umar, may Allah be pleased with him). He says, "I drank tila (grape juice boiled until it becomes thick, for example, two-thirds evaporate and one-third remains)," and I ask, "If it contains intoxication, I will administer the hadd (punishment)." Sayyiduna Umar (may Allah be pleased with him) administered the full hadd to him.

Hadith Number: 1579
وحدثني، عن وحدثني، عن مالك، عن ثور بن زيد الديلي ، ان عمر بن الخطاب استشار في الخمر يشربها الرجل، فقال له علي بن ابي طالب : نرى ان " تجلده ثمانين، فإنه إذا شرب سكر، وإذا سكر هذى، وإذا هذى افترى" او كما قال فجلد عمر في الخمر ثمانين
It is narrated from Thawr bin Zayd that Sayyiduna Umar (may Allah be pleased with him) consulted the companions regarding the punishment for wine (khamr), because the Messenger of Allah (peace and blessings be upon him) had not fixed any specific punishment for it. Sayyiduna Ali (may Allah be pleased with him) said: In my opinion, eighty lashes are appropriate, because when a person drinks wine, he becomes intoxicated, and when he becomes intoxicated, he speaks nonsense, and when he speaks nonsense, he may abuse someone or something similar (and the punishment for abuse is eighty (80) lashes). Sayyiduna Umar (may Allah be pleased with him) then fixed eighty lashes as the punishment for wine.

Hadith Number: 1580
وحدثني، عن وحدثني، عن مالك، عن ابن شهاب ، انه سئل عن حد العبد في الخمر، فقال: بلغني ان عليه نصف حد الحر في الخمر. " وان عمر بن الخطاب، وعثمان بن عفان، وعبد الله بن عمر قد جلدوا عبيدهم نصف حد الحر في الخمر"
Ibn Shihab was asked: If a slave drinks wine, what is his punishment? He said: It has reached me that the slave receives half the punishment of a free man, and Sayyiduna Umar (may Allah be pleased with him), Sayyiduna Uthman (may Allah be pleased with him), and Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) administered half the punishment of a free man to their slaves.

Hadith Number: 1581
وحدثني، عن مالك، عن يحيى بن سعيد ، انه سمع سعيد بن المسيب ، يقول: " ما من شيء إلا الله يحب ان يعفى عنه ما لم يكن حدا" . قال يحيى: قال مالك: والسنة عندنا، ان كل من شرب شرابا مسكرا فسكر او لم يسكر، فقد وجب عليه الحد
Hazrat Saeed bin Musayyib used to say that there is no sin except that Allah wants it to be forgiven, except for the prescribed punishment (hadd).
Imam Malik, may Allah have mercy on him, said: In our view, the ruling is that whoever drinks such an intoxicant in which there is intoxication, then the prescribed punishment (hadd) will be applied to him, whether he became intoxicated or not.

Hadith Number: 1581B1
قال مالك: والسنة عندنا ان كل من شرب شرابا مسكرا فسكر او لم يسكر فقد وجب عليه الحد.
Malik said: The Sunnah with us is that whoever drinks an intoxicating beverage, whether he becomes intoxicated or not, the hadd punishment is obligatory upon him.

بَابُ مَا يُكْرَهُ أَنْ يُنْبَذَ جَمِيعًا
Chapter on what is disliked to be fermented together
Hadith Number: 1582
حوحدثني يحيى، عن مالك، عن زيد بن اسلم، عن عطاء بن يسار، ان رسول الله صلى الله عليه وسلم «نهى ان ينبذ البسر والرطب جميعا والتمر والزبيب جميعا»
It is narrated from Ata bin Yasar that the Messenger of Allah, peace and blessings be upon him, forbade that unripe dates and ripe dates be soaked together, or that dates and grapes be soaked together.

Hadith Number: 1583
وحدثني عن مالك، عن الثقة عنده، عن بكير بن عبد الله بن الاشج، عن عبد الرحمن بن الحباب الانصاري، عن ابي قتادة الانصاري، ان رسول الله صلى الله عليه وسلم «نهى ان يشرب التمر والزبيب جميعا والزهو والرطب جميعا»
It is narrated from Sayyiduna Abu Qatadah Ansari, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, forbade drinking nabidh made by mixing dates and grapes, and (also) drinking nabidh made by mixing unripe and ripe dates.

Hadith Number: 1583B1
قال مالك: وهو الامر الذي لم يزل عليه اهل العلم ببلدنا انه يكره ذلك لنهي رسول اللٰه صلى الله عليه وسلم عنه.
Imam Malik, may Allah have mercy on him, said: The scholars of our city have agreed upon this matter that it is disliked, because the Messenger of Allah, peace and blessings be upon him, forbade it.

بَابُ مَا يُنْهَى أَنْ يُنْبَذَ فِيهِ
What is forbidden to use for fermentation
Hadith Number: 1584
حدثني يحيى، عن مالك، عن نافع ، عن عبد الله بن عمر ، ان رسول الله صلى الله عليه وسلم خطب الناس في بعض مغازيه، قال عبد الله بن عمر: فاقبلت نحوه، فانصرف قبل ان ابلغه، فسالت: ماذا قال؟ فقيل لي: " نهى ان ينبذ في الدباء والمزفت"
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) delivered a sermon in one of the battles. I also went towards him to listen, but before I reached, he (peace be upon him) had finished. I asked the people what he (peace be upon him) had said. The people said: He (peace be upon him) forbade soaking nabidh (a drink) in gourds and earthen jars.

Hadith Number: 1585
وحدثني، عن مالك، عن العلاء بن عبد الرحمن بن يعقوب ، عن ابيه ، عن ابي هريرة ، ان رسول الله صلى الله عليه وسلم " نهى ان ينبذ في الدباء والمزفت"
It is narrated from Sayyiduna Abu Huraira, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, forbade soaking fresh fruit in gourds and jars.
