Sahih Ibn Hibban
ذكر الزجر عن أن يرقب المرء داره أخاه المسلم-
Warning against waiting for a Muslim brother’s house to become vacant
Hadith Number: 5126
اخبرنا الحسين بن محمد بن ابي معشر ، قال: حدثنا محمد بن وهب بن ابي كريمة ، قال: حدثنا محمد بن سلمة ، عن ابي عبد الرحيم ، عن زيد بن ابي انيسة ، عن ابي الزبير ، عن طاوس ، عن ابن عباس ، عن النبي صلى الله عليه وسلم، قال: " لا ترقبوا اموالكم، فمن ارقب شيئا فهو لمن ارقبه" ، والرقبى ان يقول الرجل: هذا لفلان ما عاش، فإذا مات فلان فهو لفلان.
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates the statement of the Noble Prophet (peace and blessings of Allah be upon him): "Do not make your wealth into Raqba. Whoever makes something Raqba, then it will belong to the one for whom he made it Raqba." (Imam Ibn Hibban, may Allah have mercy on him, says:) Raqba means: A person says, 'As long as such-and-such person is alive, this is for him, and when that person dies, then it will belong to so-and-so.'
ذكر الزجر عن أن يعمر الرجل داره لأخيه المسلم-
Warning against giving one’s house to a Muslim brother for life
Hadith Number: 5127
اخبرنا عمر بن محمد الهمداني ، قال: حدثنا عبد الجبار بن العلاء ، قال: حدثنا سفيان ، عن ابن جريج ، عن عطاء ، عن جابر، قال: قال رسول الله صلى الله عليه وسلم: " لا ترقبوا ولا تعمروا، فمن اعمر شيئا او ارقب فهو له" .
Sayyiduna Jabir (may Allah be pleased with him) narrates that the Prophet Muhammad (peace and blessings be upon him) said: "Do not make (your possessions) as Ruqba or Umra. Whoever gives something as Umra or Ruqba, then it will belong to (that other person)."
ذكر البيان بأن قوله صلى الله عليه وسلم فهو له أراد به لمن أعمر ولمن أرقب-
Clarification that“it is his”refers to the one granted use or life interest
Hadith Number: 5128
اخبرنا عبد الله بن محمد الازدي ، قال: حدثنا إسحاق بن إبراهيم ، قال: حدثنا ابن فضيل ، عن داود بن ابي هند ، عن ابي الزبير، عن جابر ، عن رسول الله صلى الله عليه وسلم، قال: " العمرى لمن اعمرها، والرقبى لم ارقيها" .
Sayyiduna Jabir (may Allah be pleased with him) narrates this statement of the Prophet (peace and blessings of Allah be upon him): "Umra becomes the property of the one to whom a man has given it as Umra. Ruqba becomes the property of the one to whom it has been given as Ruqba."
ذكر إجازة العمرى إذا استعملها المرء مع أخيه المسلم-
Permissibility of life-grant (umra) if used between Muslims
Hadith Number: 5129
اخبرنا عبد الله بن محمد الازدي ، قال: حدثنا إسحاق بن إبراهيم ، قال: اخبرنا النضر بن شميل ، قال: حدثنا شعبة ، عن قتادة ، قال: سمعت عطاء بن ابي رباح يحدث، عن جابر بن عبد الله ، عن رسول الله صلى الله عليه وسلم، قال: " العمرى جائزة" .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings of Allah be upon him): "Umra is permissible."
ذكر إثبات العمرى لمن وهبت له-
Affirmation of life-grant for the recipient
Hadith Number: 5130
اخبرنا عمر بن محمد الهمداني ، قال: حدثنا محمد بن عبد الاعلى ، قال: حدثنا خالد بن الحارث ، قال: حدثنا هشام بن ابي عبد الله ، قال: حدثنا يحيى بن ابي كثير ، قال: حدثني ابو سلمة بن عبد الرحمن ، قال: سمعت جابر بن عبد الله ، يقول: قال رسول الله صلى الله عليه وسلم: " العمرى لمن وهبت له" .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) narrates that the Prophet Muhammad (peace and blessings be upon him) said: "‘Umra becomes the property of the one to whom it is gifted."
ذكر إثبات العمرى لمن أعمرت له-
Affirmation of life-grant for the one granted it
Hadith Number: 5131
اخبرنا محمد بن احمد بن ابي عون ، قال: حدثنا علي بن حجر ، قال: حدثنا إسماعيل بن جعفر ، عن محمد بن عمرو ، عن ابي سلمة ، عن ابي هريرة ، ان رسول الله صلى الله عليه وسلم، قال: " لا عمرى، ومن اعمر شيئا فهو له" .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings be upon him): "Umra (is not correct). Whoever gives something as Umra, then it will belong to the one to whom it was given as Umra."
ذكر خبر قد وهم في تأويله من لم يحكم صناعة الحديث-
Report misinterpreted by those unfamiliar with hadith science
Hadith Number: 5132
اخبرنا محمد بن الحسين بن مكرم ، قال: حدثنا محمد بن عبد الله بن بزيع ، قال: حدثنا يزيد بن زريع ، قال: حدثنا روح بن القاسم ، عن عمرو بن دينار ، عن طاوس ، عن حجر المدري ، عن زيد بن ثابت ، عن النبي صلى الله عليه وسلم، قال: " العمرى سبيلها سبيل الميراث" .
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings of Allah be upon him): "The method of 'Umariyyah will be according to the method of inheritance (that is, the rulings of inheritance will apply to it)."
ذكر قضاء المصطفى صلى الله عليه وسلم بالعمرى للوارث على حسب ما جعل سبيلها سبيل الميراث-
Prophet’s ruling that life-grant passes to heirs as inheritance
Hadith Number: 5133
اخبرنا مسلم بن معاذ بدمشق، قال: حدثنا العباس بن الوليد مزيد ، قال: حدثنا ابي ، قال: حدثنا الاوزاعي ، قال: حدثني عمرو بن دينار ، عن طاوس ، عن حجر المدري ، عن زيد بن ثابت :" ان النبي صلى الله عليه وسلم قضى بالعمرى للوارث" .
Sayyiduna Zayd bin Thabit (may Allah be pleased with him) narrates: The Prophet Muhammad (peace and blessings be upon him) gave the ruling of ‘Umra in favor of the heir.
ذكر البيان بأن قوله صلى الله عليه وسلم العمرى سبيلها سبيل الميراث أراد بذلك لمن أعمر دون من أعمر-
Clarification that“life-grant is like inheritance”refers to the recipient, not the grantor
Hadith Number: 5134
اخبرنا محمد بن موسى التيمي بالمصيصة، قال: حدثنا محمد بن قدامة ، قال: حدثنا ابو عبيدة الحداد ، قال: حدثنا سليم بن حيان ، عن عمرو بن دينار ، عن طاوس ، عن حجر المدري ، عن زيد بن ثابت ، قال: قال رسول الله صلى الله عليه وسلم: " من اعمر ارضا فهي لورثته" .
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) narrates: The Prophet Muhammad (peace and blessings be upon him) said: "The person who is given land as 'Umra, it will go to his heirs."
ذكر الخبر المصرح بصحة ما ذكرناه أن ميراث العمرى يكون للمعمر له دون من أعمرها-
Report confirming that inheritance of life-grant is for the recipient, not the grantor
Hadith Number: 5135
اخبرنا عبد الله بن محمد بن سلم ، قال: حدثنا عبد الرحمن بن إبراهيم ، قال: حدثنا الوليد ، قال: حدثنا الاوزاعي ، عن الزهري، عن ابي سلمة ، عن جابر ، عن النبي صلى الله عليه وسلم، قال: " العمرى لمن اعمرها هي له ولعقبه، يرثها من يرثه من عقبه" .
Sayyiduna Jabir (may Allah be pleased with him) narrates this statement of the Prophet (peace and blessings be upon him): "The 'Umra' will belong to the person to whom it is given as 'Umra', and it will go to his heirs, and whoever among his heirs becomes his inheritor will also inherit the 'Umra'."
