Allah’s saying:“Those who accuse their wives of adultery and have no witnesses but themselves...”(Surah Nur: 8)
Narrated from Sayyiduna Sahl bin Sa’d (may Allah be pleased with him) that Sayyiduna Uwaymir came to Sayyiduna Asim bin ‘Adi (may Allah be pleased with them both) and said,“If a person sees a man committing adultery with his wife, should he kill him? (If he kills him,) then will you people also kill him (in retribution)? If he does not kill, then what should he do? Ask this (issue) for me from the Messenger of Allah (peace and blessings of Allah be upon him).”Sayyiduna Asim (may Allah be pleased with him) came to the Prophet (peace and blessings of Allah be upon him) and asked him, but the Messenger of Allah (peace and blessings of Allah be upon him) did not like such questions to be asked and considered it bad. Then Sayyiduna Uwaymir (may Allah be pleased with him) asked him, so he said that the Prophet (peace and blessings of Allah be upon him) disliked asking such things. Sayyiduna Uwaymir (may Allah be pleased with him) said,“By Allah, I will never stop until I ask the Messenger of Allah (peace and blessings of Allah be upon him) about this issue,”and he came to the Prophet (peace and blessings of Allah be upon him) and said,“O Messenger of Allah! If a man sees another man (committing adultery) with his wife, should he kill him? (If he kills him,) will you kill him (in retribution)? So tell me, what should that person do now?”The Messenger of Allah (peace and blessings of Allah be upon him) said:“Allah Almighty has revealed (verses of) the Qur’an regarding you and your wife.”Sayyiduna Uwaymir (may Allah be pleased with him) performed li’an (mutual cursing) with his wife and then said,“O Messenger of Allah! If I keep my wife with me, it is as if I have wronged her, i.e., made a false accusation.”So Sayyiduna Uwaymir (may Allah be pleased with him) divorced her. (The narrator says that) after this incident, this method was established for such husband and wife who perform li’an. Then the Messenger of Allah (peace and blessings of Allah be upon him) said:“Look! If this woman (Uwaymir’s wife) gives birth to a child who is dark, with large black eyes, big buttocks, and thick legs, then I will consider that indeed Uwaymir (may Allah be pleased with him) has made a false accusation against his wife (because these characteristics were in Uwaymir (may Allah be pleased with him)).”Eventually, the woman gave birth to a child with the same features as the Messenger of Allah (peace and blessings of Allah be upon him) had confirmed for Sayyiduna Uwaymir (may Allah be pleased with him) (i.e., dark, with black eyes, big buttocks, and thick legs), so that child was attributed to his mother (no one called him by his father’s name).
Allah’s saying:“The punishment is averted from her if she testifies four times by Allah that he is lying...”(Surah Nur: 8)
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that Sayyiduna Hilal bin Umayyah (may Allah be pleased with him) accused his wife of committing adultery with Sharik bin Sahma in the presence of the Messenger of Allah (peace and blessings of Allah be upon him). The Prophet (peace and blessings of Allah be upon him) said: "Bring evidence, otherwise the punishment of qazf (i.e., 80 lashes) will be imposed on your back." He said, "O Messenger of Allah! If any one of us sees someone doing something bad with his wife, whom should he bring as a witness (and whom should he call to testify)?" The Prophet (peace and blessings of Allah be upon him) kept saying: "Bring evidence, otherwise the punishment will be imposed on you." So Hilal said, "By Him Who sent you with the truth, I am truthful, and Allah will surely reveal a command concerning me that will save my back from punishment." At that very moment, Jibreel (peace be upon him) descended and this verse was revealed: "And those who accuse their wives of adultery..." The Prophet (peace and blessings of Allah be upon him) recited it, and when he reached the verse, "if her husband is truthful" (An-Nur: 6-9), the Messenger of Allah (peace and blessings of Allah be upon him) returned and called for Hilal's wife, and Hilal also came, and they both gave the testimonies of li'an. The Prophet (peace and blessings of Allah be upon him) used to say: "Indeed, Allah knows that one of you is surely lying, so is there anyone among you who will repent?" Then the woman stood up and gave (four) testimonies (i.e., she said four times: I call Allah to witness that I am truthful), and when she was about to say it the fifth time (that if I am lying, may the curse of Allah be upon me), the people stopped her and said, "This testimony (if it is a lie) will bring punishment upon you." Sayyiduna Ibn Abbas (may Allah be pleased with them both) said that she hesitated and lowered her neck, from which we thought that she would confess (but) then she said, "I cannot disgrace my people forever," and she said the fifth statement as well. The Prophet (peace and blessings of Allah be upon him) said: "Look! If a child is born with black eyes, large buttocks, and thick shins, then it is from the seed of Sharik bin Sahma." So such a child was born, and at that time the Prophet (peace and blessings of Allah be upon him) said: "If Allah's command had not come, you would have seen what I would have done to this woman."
