Mukhtasar Sahih Bukhari
Allah's command on divorce and waiting period (iddah).
Narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that: I divorced my wife during the time of the Messenger of Allah (peace and blessings be upon him) while she was menstruating. (My father) Sayyiduna Umar bin Khattab (may Allah be pleased with him) asked the Messenger of Allah (peace and blessings be upon him) about this, so he (peace and blessings be upon him) said: "Command him to take her back, then keep her until she becomes pure, then when her period comes and she becomes pure again, then if he wishes he may keep her, and if he wishes he may divorce her before having intercourse with her. This is the waiting period regarding which Allah has commanded that women should be divorced at such a time."
Divorce during menstruation counts.
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both), he says: (The divorce I gave during the days of menstruation) was counted as one divorce against me.
Is it necessary to face the wife when divorcing?
Umm al-Mu'mineen Aisha (may Allah be pleased with her) says that when the daughter of Jun came to the Messenger of Allah (peace and blessings of Allah be upon him) after marriage and he approached her, she said, "I seek Allah's protection from you." The Prophet (peace and blessings of Allah be upon him) said to her: "You have sought protection from the Great One. (Go) join your family."
In another narration, Sayyiduna Abu Usaid (may Allah be pleased with him) says that the Prophet Muhammad (peace and blessings be upon him) went to her (the woman, daughter of Jun) and with her was her nurse, the one who had breastfed her. The Prophet (peace and blessings be upon him) said to her, "Give yourself to me." She replied, "Can a queen give herself to ordinary people?" (Then) he says that the Prophet (peace and blessings be upon him) thought to put his hand on her to calm her, but she said, "I seek refuge with Allah from you." The Prophet (peace and blessings be upon him) said, "You have sought refuge with the Great Protector." Then he came to us and said, "O Abu Usaid! Dress her in two Razqi garments and take her to her family."
Who permits giving three divorces at once.
Umm al-Mu’minin Aisha (may Allah be pleased with her) narrates that the wife of Rifa’ah al-Qurazi came to the Messenger of Allah (peace and blessings be upon him) and said,“O Messenger of Allah! Rifa’ah divorced me and it became an irrevocable (final) divorce. After that, I married ‘Abdur-Rahman bin Zubair al-Qurazi (but) he is impotent.”The Prophet (peace and blessings be upon him) said:“Perhaps you want to return to Rifa’ah? You cannot (return) until he (‘Abdur-Rahman) tastes your sweetness and you taste his sweetness.”
Allah's command: "O Prophet, why do you forbid what Allah has made lawful for you?"
Umm al-Mu’minin Aisha (may Allah be pleased with her) narrates: The Messenger of Allah (peace and blessings be upon him) was very fond of sweets and honey, and it was his blessed habit that after performing the Asr prayer, he would go to his wives, and sometimes he would kiss and embrace one of them. (One day) he went to Umm al-Mu’minin Hafsa bint Umar (may Allah be pleased with her) and stayed there longer than usual. (Because of this) I felt jealous and inquired about the reason, so someone told me that (Umm al-Mu’minin Hafsa, may Allah be pleased with her) had been given a jar of honey as a gift by a woman from her tribe. She gave that honey to the Prophet (peace and blessings be upon him) to drink (and that is why he was delayed). I said,“By Allah! I will devise a plan.”I said to Umm al-Mu’minin Sawda (may Allah be pleased with her) that when the Prophet (peace and blessings be upon him) comes to you, say to him, ‘Perhaps you have eaten Maghafir?’ The Prophet (peace and blessings be upon him) will deny it, then you should say, ‘Then why do I smell an odor from your mouth?’ When he tells you, ‘I drank honey at Hafsa’s (may Allah be pleased with her) place,’ then you should say, ‘Perhaps the bees of that (honey) sucked the sap of the ‘Urft tree,’ and I will say the same, and O Safiyyah! You should also say the same.”Hazrat Aisha (may Allah be pleased with her) narrates that Sawda (may Allah be pleased with her) used to say that when the Messenger of Allah (peace and blessings be upon him) came and was just standing at the door, I intended to say what you had told me out of fear of you. Aisha (may Allah be pleased with her) narrates that when the Messenger of Allah (peace and blessings be upon him) came near Sawda (may Allah be pleased with her), she said to him,“O Messenger of Allah! Have you eaten Maghafir?”The Prophet (peace and blessings be upon him) replied,“No.”She said,“Then why do I smell an odor from your mouth?”The Prophet (peace and blessings be upon him) replied,“Hafsa gave me a little honey to drink.”She said,“Perhaps its bee sucked the sap of the ‘Urft tree.”When he came to me, I also said the same to him, and when he went to Safiyyah (may Allah be pleased with her), she also said the same, and when he went again to Hafsa (may Allah be pleased with her), she said,“O Messenger of Allah! Shall I bring you some honey to drink?”The Prophet (peace and blessings be upon him) replied,“I have no need for honey.”Aisha (may Allah be pleased with her) narrates that Sawda (may Allah be pleased with her) said,“By Allah! We have deprived the Messenger of Allah (peace and blessings be upon him) of honey.”I said,“Be quiet (lest the Messenger of Allah (peace and blessings be upon him) find out).”
Ruling on Khul' divorce and Allah's statement about not taking back gifts.
Narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them) that the wife of Sayyiduna Thabit bin Qais (may Allah be pleased with him) came to the Prophet (peace and blessings of Allah be upon him) and said, "O Messenger of Allah! I do not dislike Thabit bin Qais because of any bad character or religious fault, but I dislike (to live with him) and I fear that I may fall into ingratitude (of blessings) while being a Muslim." The Messenger of Allah (peace and blessings of Allah be upon him) said, "Will you return his garden (which he gave you as mahr)?" She said, "Yes." The Messenger of Allah (peace and blessings of Allah be upon him) said, "(O Thabit!) Take back your garden and give her one divorce."
The Prophet's intercession for Barirah's husband.
Narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that Barirah’s husband was a slave whose name was Mughith. It is as if I am seeing him (the poor man) walking behind her, weeping, and his tears are falling down his beard. So the Messenger of Allah (peace and blessings of Allah be upon him) said to Sayyiduna Abbas (may Allah be pleased with him):“O Abbas! Are you not amazed at Mughith’s love for Barirah and Barirah’s aversion to Mughith?”Then the Noble Prophet (peace and blessings of Allah be upon him) said:“O Barirah! If you return to him (it would be good).”She said:“O Messenger of Allah! Are you commanding me to do so?”He (peace and blessings of Allah be upon him) said:“(No)! I am only interceding.”So she (Barirah) replied:“I have no need of him.”
Chapter on Li'an (mutual cursing).
Sahl bin Sa’d Sa’idi (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings of Allah be upon him) said:“I and the one who takes care of an orphan will be like this in Paradise,”and he indicated with his index finger and middle finger, leaving a small gap between them. (Benefit: Imam Bukhari refuted those who consider gestures permissible in matters like divorce but not in li’an, by clarifying here that gestures are also permissible in li’an and similar matters. Secondly, the complete ahadith regarding li’an have already been mentioned earlier, so they have not been repeated here for fear of repetition.)
If a husband hints that a child is not his.
Narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) that a man came to the Prophet (peace and blessings of Allah be upon him) and said, "O Messenger of Allah! A black child has been born to me." The Prophet (peace be upon him) said, "Do you have camels?" He replied, "Yes." The Prophet (peace be upon him) asked, "What is their color?" He replied, "They are red." The Prophet (peace be upon him) asked, "Is there any among them that is grayish (dust-colored)?" He said, "Yes." The Prophet (peace be upon him) said, "How did that happen?" He replied, "Perhaps some vein of the female drew that color." The Prophet (peace be upon him) said, "Perhaps some vein of your son has drawn that color as well." (Thus, he himself became convinced that his suspicion was unfounded.)
