باب القسم للخيل فى الغزو
Chapter on Distribution for Horses in Battle
Hadith Number: 979
حدثني يحيى، عن مالك، انه قال: بلغني ان عمر بن عبد العزيز، كان يقول: " للفرس سهمان وللرجل سهم" . قال مالك: ولم ازل اسمع ذلك.
Imam Malik, may Allah have mercy on him, said: Hazrat Umar bin Abdul Aziz, may Allah have mercy on him, said: The horse has two shares, and the man has one share. Imam Malik, may Allah have mercy on him, said: I have always heard it like this.

Hadith Number: 979B1
وسئل مالك، عن رجل يحضر بافراس كثيرة، فهل يقسم لها كلها؟ فقال: لم اسمع بذلك، ولا ارى ان يقسم إلا لفرس واحد الذي يقاتل عليه
Imam Malik (may Allah have mercy on him) was asked: If a person brings many horses, will all the horses receive a share? He replied: No, only the horse on which he rides and fights will receive a share.

Hadith Number: 979B2
. قال مالك: لا ارى البراذين، والهجن إلا من الخيل، لان الله تبارك وتعالى قال في كتابه: والخيل والبغال والحمير لتركبوها وزينة سورة النحل آية 8، وقال عز وجل: واعدوا لهم ما استطعتم من قوة ومن رباط الخيل ترهبون به عدو الله وعدوكم سورة الانفال آية 60 فانا ارى البراذين والهجن من الخيل إذا اجازها الوالي. وقد قال سعيد بن المسيب وسئل، عن البراذين، هل فيها من صدقة؟ فقال: " وهل في الخيل من صدقة؟"
Imam Malik, may Allah have mercy on him, said: In my view, Turki and Mujannis are also included among horses, because Allah the Exalted has said: "We created horses, mules, and donkeys for you to ride." And Allah the Exalted has said: "Prepare against them (the disbelievers) whatever you are able of power and of steeds of war, by which you may terrify the enemy of Allah and your enemy." So in my view, Turki and Mujannis will be counted among horses when the ruler accepts them. Someone asked Hazrat Sa'id bin al-Musayyib whether there is zakat on Turki horses? He replied: Is there zakat on horses at all?
