‘Amir al-Sha‘bi narrates: We went to Lady Fatimah bint Qays (may Allah be pleased with her), and we said to her:“Narrate to us the hadith in which the decision of the Prophet (peace and blessings be upon him) regarding you is mentioned.”So Lady Fatimah bint Qays (may Allah be pleased with her) said: I went to the Prophet (peace and blessings be upon him), and my brother-in-law was with me. I said:“My husband has divorced me, and he (i.e., my brother-in-law) says that I will not get accommodation and maintenance.”The Prophet (peace and blessings be upon him) said:“You will get accommodation and maintenance.”(Her brother-in-law) said:“Her husband has given her three divorces.”So the Prophet (peace and blessings be upon him) said:“Accommodation and maintenance are for the woman whose husband has the right to take her back.”Al-Sha‘bi narrates: When I came to Kufa, al-Aswad ibn Yazid called me to ask me about this. The students of Abdullah ibn Mas‘ud (may Allah be pleased with him) say: Such a woman will get accommodation and maintenance.
