باب من أعتق عبدا أو شرط عليه خدمته وحكم من ملك ذا رحم محرم أو أعتق مالم يملك
Chapter on Whoever Frees a Slave or Conditions His Service, and the Ruling of One Who Owns a Forbidden Relative or Frees What He Does Not Own
Hadith Number: 5264
عن عمرو بن شعيب عن ابيه عن جده عن النبي صلى الله عليه وآله وسلم قال ليس على رجل طلاق فيما لا يملك ولا عتاق فيما لا يملك ولا بيع فيما لا يملك
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: There is no divorce for a man in that which he does not own, there is no emancipation in that which he does not own, and there is no transaction in that which is not in his possession.
