باب أن دية المقتول لجميع ورتيه، وما جاء فى ميرات الحمل بعد وضعه إن استهل
Chapter: That the blood money of the murdered belongs to all his heirs, and what has been reported regarding the inheritance of a fetus if it cries after birth
Hadith Number: 6343
عن سعيد بن المسيب ان عمر بن الخطاب رضي الله عنه قال ما ارى الدية إلا للعصبة لانهم يعقلون عنه فهل سمع احد منكم من رسول الله صلى الله عليه وآله وسلم في ذلك شيئا فقام الضحاك بن سفيان الكلابي وكان استعمله رسول الله صلى الله عليه وآله وسلم على الاعراب كتب إلي رسول الله صلى الله عليه وآله وسلم ان اورث امراة اشيم الضبابي من دية زوجها فاخذ بذلك عمر بن الخطاب
It is narrated from Saeed bin Musayyib that Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: My opinion is that the blood money should be given only to the 'Asabah (male agnates), because they are the ones who pay the blood money. Has any one of you heard anything from the Messenger of Allah (peace and blessings be upon him) regarding this? Sayyiduna Dahiak bin Sufyan Kalabi (may Allah be pleased with him)—the Messenger of Allah (peace and blessings be upon him) had appointed him as the governor over the Bedouin people—stood up and said: The Messenger of Allah (peace and blessings be upon him) sent me this written order that I should make the wife of Ashyam Dubabi an heir from her husband's blood money.
