Book of Divorce
باب أم الولد يكون لها من سيدها أولاد فيموت عنها فتزوج فتلد منه أولادا، ثم يموت بعض ولدها من السيد
Chapter: Umm al-Walad who has children from her master, then he dies, then she marries and bears children from him, then some of her children from the master die
Hadith Number: 1956
نا هشيم، قال: انا يونس، عن الحسن، في عبد مملوك تحته امراة حرة، وله اخ حر، فمات اخوه ولم يدع وارثا قال: " يمسك العبد عن امراته حتى يعلم ابها حمل او ليس بها؟ فإن كان بها حمل ورث ولدها عمه"، وكان يقول في رجل عنده امراة لها ولد من غيره فمات ولدها ذاك، قال:" يمسك الرجل عن امراته حتى يعلم ابها حمل ام لا؟" .
Hasan (may Allah have mercy on him) said: "When a slave marries a free woman and her free brother dies, then the slave should refrain from his wife until it is known whether she is pregnant or not. If she is pregnant, then the child will be the heir of his uncle."
