ذكر خبر قد يوهم غير المتبحر في صناعة العلم أن إجارة الأرض بالدراهم غير جائزة-
Report that may mislead the unlearned to think renting land for money is not allowed
Hadith Number: 5148
اخبرنا الحسن بن سفيان ، قال: حدثنا حبان ، قال: اخبرنا عبد الله ، قال: اخبرنا عبد الملك بن ابي سليمان ، عن عطاء ، عن جابر بن عبد الله ، قال: قال رسول الله صلى الله عليه وسلم: " من كانت له ارض فليزرعها، فإن لم يستطع ان يزرعها فليمنحها اخاه، ولا يؤاجرها إياه" ، قال ابو حاتم: قوله صلى الله عليه وسلم: ولا يؤاجرها إياه، لفظة زجر عن فعل قصد بها الندب والإرشاد، لان القوم كان بهم الضيق في العيش والمنحة كانت اوقع عندهم للارض من إكرائها، فاما المسلمون فإنهم مجمعون على جواز كري الارض إلا الجنس الذي نهى عنه رسول الله صلى الله عليه وسلم.
Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) narrates that the Prophet Muhammad (peace and blessings be upon him) said: "Whoever has land should cultivate it; if he cannot cultivate it, then he should give it to his brother free of charge, and he should not take rent from him for it."
(Imam Ibn Hibban, may Allah have mercy on him, says:) The statement of the Prophet (peace and blessings be upon him): "He should not take compensation from him"—here, the prohibition is in wording, but the intent is to express recommendation and guidance, because people used to face hardship in their affairs, so giving land as a gift was considered better than renting it out. Otherwise, all Muslims are agreed upon this: it is permissible to take rent for land, except for the type which the Prophet (peace and blessings be upon him) has prohibited.
