باب مَا جَاءَ فِي أَرْضِ الْمُشْتَرَكِ يُرِيدُ بَعْضُهُمْ بَيْعَ نَصِيبِهِ
Chapter: Joint Property Where a Partner Wishes to Sell His Share
Hadith Number: 1312
حدثنا علي بن خشرم، حدثنا عيسى بن يونس، عن سعيد، عن قتادة، عن سليمان اليشكري، عن جابر بن عبد الله، ان نبي الله صلى الله عليه وسلم، قال: " من كان له شريك في حائط، فلا يبيع نصيبه من ذلك، حتى يعرضه على شريكه ". قال ابو عيسى: هذا حديث إسناده ليس بمتصل، سمعت محمدا يقول: سليمان اليشكري، يقال: إنه مات في حياة جابر بن عبد الله، قال: ولم يسمع منه قتادة، ولا ابو بشر، قال محمد: ولا نعرف لاحد منهم سماعا من سليمان اليشكري، إلا ان يكون عمرو بن دينار، فلعله سمع منه في حياة جابر بن عبد الله، قال: وإنما يحدث قتادة، عن صحيفة سليمان اليشكري، وكان له كتاب عن جابر بن عبد الله، حدثنا ابو بكر العطار عبد القدوس قال: قال علي بن المديني، قال يحيى بن سعيد: قال سليمان التيمي: ذهبوا بصحيفة جابر بن عبد الله إلى الحسن البصري فاخذها، او قال: فرواها، وذهبوا بها إلى قتادة، فرواها، واتوني بها، فلم اروها، يقول: رددتها.
Jabir bin Abdullah (may Allah be pleased with both of them) says that the Prophet Muhammad (peace and blessings of Allah be upon him) said: "If a man has a partner in his orchard, he should not sell his share until he first offers it to his partner."
Imam Tirmidhi says:
1- The chain of this hadith is not connected.
2- I heard Muhammad bin Ismail Bukhari say: It is said about Sulaiman Yashkuri that he died during the lifetime of Jabir bin Abdullah, and Qatadah and Abu Bishr did not hear from him. Muhammad bin Ismail Bukhari says: I do not know that any of them heard anything from Sulaiman Yashkuri except Amr bin Dinar; perhaps he heard hadith from Sulaiman Yashkuri during the lifetime of Jabir bin Abdullah. He says that Qatadah used to narrate hadith from the book of Sulaiman Yashkuri; Sulaiman had a book in which were written hadiths narrated from Jabir bin Abdullah.
3- Sulaiman Tamimi says: People took the book of Jabir bin Abdullah to Hasan Basri, so he took it or narrated from it. And people took it to Qatadah, so he also narrated from it, and they brought it to me, but I did not narrate from it; I rejected it.
