When does a newborn become an heir?
Numbering by, Al-Albani: 153, Fiqh-based: ,1294
-" إذا استهل المولود ورث".
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: "If the child cries (after birth), then he will be made an heir."

-" لا يرث الصبي حتى يستهل صارخا، واستهلاله ان يصيح او يعطس او يبكي".
It is narrated from Sayyiduna Jabir bin Abdullah and Sayyiduna Miswar bin Makhramah (may Allah be pleased with them), the Messenger of Allah (peace and blessings of Allah be upon him) said: "As long as the (newborn) child does not cry, he is not made an heir. His crying is that he screams, sneezes, or weeps."
