باب قَوْلِ عُمَرَ في الْجَدِّ:
Chapter on Umar's opinion regarding the grandfather
Hadith Number: 2947
اخبرنا محمد بن عيينة، عن علي بن مسهر، عن عاصم، عن الشعبي، قال: "إن اول جد ورث في الإسلام عمر.
Shu’bi (may Allah have mercy on him) said: In Islam, the first person to inherit as a grandfather was Sayyiduna ‘Umar (may Allah be pleased with him).

Hadith Number: 2948
حدثنا حدثنا ابو نعيم، حدثنا حسن، عن عاصم، عن الشعبي، قال: "اول جد ورث في الإسلام عمر، فاخذ ماله، فاتاه علي، وزيد، فقالا: ليس لك ذاك، إنما انت كاحد الاخوين".
Shu’bi (may Allah have mercy on him) said: The first grandfather to inherit in Islam was Sayyiduna ‘Umar (may Allah be pleased with him); he took his share, so Sayyiduna ‘Ali and Sayyiduna Zayd (may Allah be pleased with them both) came to him and said: Not like this, you are like two brothers.

Hadith Number: 2949
حدثنا عبيد الله بن موسى، عن عيسى الخياط، عن الشعبي، قال: كان عمر "يقاسم بالجد مع الاخ والاخوين، فإذا زادوا اعطاه الثلث، وكان يعطيه مع الولد السدس.
Shu'bi, may Allah have mercy on him, said: Sayyiduna Umar, may Allah be pleased with him, used to include the grandfather in the division along with one or two brothers; if the brothers were more, he would give the grandfather one-third, and with children, he would give him one-sixth.

Hadith Number: 2950
حدثنا حدثنا مسلم بن إبراهيم، حدثنا وهيب، حدثنا هشام بن عروة، عن ابيه، عن مروان بن الحكم: ان عمر بن الخطاب لما طعن، استشارهم في الجد، فقال: "إني كنت رايت في الجد رايا، فإن رايتم ان تتبعوه، فاتبعوه، فقال له عثمان: إن نتبع رايك فإنه رشد، وإن نتبع راي الشيخ، فنعم ذو الراي كان.
It is narrated from Marwan bin Al-Hakam that when Sayyiduna Umar bin Al-Khattab (may Allah be pleased with him) was wounded by a spear, he consulted the companions regarding the grandfather, and said: "I had an opinion regarding the grandfather; if you wish, you may follow it." Sayyiduna Uthman (may Allah be pleased with him) said: "If we follow your opinion, it is a path of guidance, and if we accept the opinion of the Shaykh (Sayyiduna Abu Bakr, may Allah be pleased with him), he too was a man of very good opinion."
