It is narrated from ‘Amir (Sha‘bi) رحمه الله that Masruq رحمه الله used to consider the paternal aunt, in the absence of the father, in the position of the father, and the maternal aunt, when there was no maternal uncle, in the position of the mother. That is, in the absence of the parents, he would give the paternal aunt and maternal aunt the share of inheritance of the father and mother.

It is narrated from Wasi‘ bin Hibban that Ibn al-Dahdahah passed away and he used to come, meaning there was no information about his relatives or kin. He was from Banu ‘Ajlan and had left behind no heirs. The Messenger of Allah (peace and blessings be upon him) said to Sayyiduna ‘Asim bin ‘Adi (may Allah be pleased with him):“Do you have knowledge of his lineage among your tribe?”He replied: O Messenger of Allah! We do not know him. So the Messenger of Allah (peace and blessings be upon him) called his nephew and gave him his entire inheritance.

Ibrahim (may Allah have mercy on him) narrated that Sayyiduna Umar (may Allah be pleased with him) gave inheritance wealth to the maternal uncle.

Abu Hani said: 'Amir Sha'bi, may Allah have mercy on him, was asked: If a woman or a man passes away, and leaves behind a maternal aunt and a paternal aunt, and besides them there is no other heir or relative, Sha'bi, may Allah have mercy on him, said: Sayyiduna Abdullah ibn Mas'ud, may Allah be pleased with him, used to give the maternal aunt the share of the mother and the paternal aunt the share of her brother, that is, the deceased woman's brother.
