باب في الرَّجُلِ يُوصِي لِغَيْرِ قَرَابَتِهِ:
Chapter on a man bequeathing to non-relatives
Hadith Number: 3299
حدثنا مسلم بن إبراهيم، حدثنا حماد بن زيد، حدثنا شيبة بن هشام الراسبي، وكثير بن معدان، قالا: سالنا سالم بن عبد الله عن"الرجل يوصي في غير قرابته، فقال سالم: هي حيث جعلها، قال: فقلنا: إن الحسن يقول: يرد على الاقربين، فانكر ذلك، وقال قولا شديدا".
Shaibah bin Hisham Rasabi and Kathir bin Ma'dan both said: We asked Salim bin Abdullah: If a man makes a bequest for a non-relative? Salim said: As he said, it will be executed. We said: Hasan (may Allah have mercy on him) refers such a bequest back to the relatives. Upon this, Salim strongly disapproved.

Hadith Number: 3300
حدثنا حدثنا احمد بن عبد الله، حدثنا ابو شهاب، عن عمرو، عن الحسن، قال: "إذا اوصى الرجل في قرابته، فهو لاقربهم ببطن: الذكر والانثى فيه سواء".
Hasan (may Allah have mercy on him) said: When a man makes a bequest for a relative, it is for the closest among the tribe, and men and women are all equal in this.
