From the Book of Wills
باب إِذَا قَالَ أَحَدُ غُلاَمَيَّ حُرٌّ ثُمَّ مَاتَ وَلَمْ يُبَيِّنْ:
Chapter on someone who says "one of my slaves is free" then dies without specifying
Hadith Number: 3301
حدثنا احمد بن عبد الله، حدثنا ابو بكر، عن مطرف، عن الشعبي:"في رجل قال: احد غلامي حر ثم مات، ولم يبين، قال: الورثة بمنزلته يعتقون ايهما احبوا".
Shu’bi, may Allah have mercy on him, said: If a man says: One of my two slaves is free, and he dies before specifying which one, then Shu’bi, may Allah have mercy on him, said: The heirs of the one who made the bequest will take his place, and whichever of the two they consider better, they will set free.
