بَابُ الْحُكْمِ فِي الصَّيْدِ
Ruling on Hunting
Hadith Number: 787Q2
قال مالك: قال اللٰه تبارك وتعالى ﴿يا ايها الذين آمنوا لا تقتلوا الصيد وانتم حرم. ومن قتله منكم متعمدا. فجزاء مثل ما قتل من النعم يحكم به ذوا عدل منكم، هديا بالغ الكعبة، او كفارة طعام مساكين، او عدل ذلك صياما ليذوق وبال امره﴾ [المائدة: 95]
Imam Malik, may Allah have mercy on him, said: Allah, Glorious and Exalted is He, said: "O you who believe! Do not kill game while you are in the state of ihram, and whoever among you kills it intentionally, then the penalty is an animal of the like of what he killed, as judged by two just men among you, as an offering brought to the Ka'bah, or as an expiation, feeding the poor or its equivalent in fasting, so that he may taste the consequence of his deed."

قال مالك: فالذي يصيد الصيد وهو حلال. ثم يقتله وهو محرم. بمنزلة الذي يبتاعه وهو محرم. ثم يقتله. وقد نهى اللٰه عن قتله. فعليه جزاؤه
Imam Malik, may Allah have mercy on him, said: If a person hunts and it is lawful, then he kills it while in the state of ihram, it is as if a muhrim buys the game and then kills it. Allah has forbidden its killing, so its compensation becomes obligatory upon him.

والامر عندنا ان من اصاب الصيد وهو محرم حكم عليه
Imam Malik, may Allah have mercy on him, said: In our view, the ruling is that whoever hunts while in the state of ihram, the judgment of compensation will be imposed upon him.

قال مالك: احسن ما سمعت في الذي يقتل الصيد فيحكم عليه فيه، ان يقوم الصيد الذي اصاب، فينظر كم ثمنه من الطعام، فيطعم كل مسكين مدا. او يصوم مكان كل مد يوما. وينظر كم عدة المساكين. فإن كانوا عشرة صام عشرة ايام، وإن كانوا عشرين مسكينا صام عشرين يوما عددهم ما كانوا، وإن كانوا اكثر من ستين مسكينا
Imam Malik, may Allah have mercy on him, said: I have heard very well in this chapter that if a person hunts, then the value of that game will be assessed, and it will be calculated how much grain comes from its value. So, he should give each mudd to a poor person, or for each mudd, he should fast one day, and look at the number of the poor. If they are ten, then ten fasts; and if they are twenty, then twenty fasts. Even if it exceeds sixty poor people.

قال مالك: سمعت انه يحكم على من قتل الصيد في الحرم وهو حلال، بمثل ما يحكم به على المحرم الذي يقتل الصيد في الحرم وهو محرم
Imam Malik, may Allah have mercy on him, said: Whoever hunts game in the Haram and it is lawful, then its ruling is the same as that of one who hunts game in the Haram while in the state of Ihram.
