Chapter on Actions Regarding Compensation for Teeth
Hadith Number: 1517
وحدثني وحدثني يحيى، عن مالك، عن داود بن الحصين ، عن ابي غطفان بن طريف المري انه اخبره , ان مروان بن الحكم بعثه إلى عبد الله بن عباس يساله: ماذا في الضرس؟ فقال عبد الله بن عباس : " فيه خمس من الإبل"، قال: فردني مروان إلى عبد الله بن عباس، فقال: اتجعل مقدم الفم مثل الاضراس؟ فقال عبد الله بن عباس:" لو لم تعتبر ذلك إلا بالاصابع عقلها سواء"
It is narrated from Abu Ghatfan bin Tarif that Marwan bin Hakam sent him to Abdullah bin Abbas (may Allah be pleased with them both) to ask what is the compensation (diyah) for a molar tooth. Ibn Abbas (may Allah be pleased with them both) said: It is five camels. Marwan then sent him again and asked: Are the front teeth and the molars equal in compensation? Ibn Abbas (may Allah be pleased with them both) said: If you had compared the teeth to the fingers, it would have been sufficient; the compensation for each finger is the same (even though the benefit of some is less and some is more, likewise, all teeth and molars are equal).

Hadith Number: 1518
وحدثني يحيى، عن مالك، عن هشام بن عروة، عن ابيه انه كان " يسوي بين الاسنان في العقل ولا يفضل بعضها على بعض" .
Hazrat Urwah bin Zubair used to say that in earlier times, the blood money for all teeth was equal; none was greater than the other.

قال مالك: والامر عندنا ان مقدم الفم والاضراس والانياب عقلها سواء، وذلك ان رسول الله صلى الله عليه وسلم قال في السن:" خمس من الإبل"، والضرس سن من الاسنان، لا يفضل بعضها على بعض
Imam Malik, may Allah have mercy on him, said: In our view, the ruling is that the teeth, the canine teeth, and the molars are all equal, because the Messenger of Allah, peace and blessings be upon him, prescribed five camels for each tooth; the molar is also a tooth.
