92| Chapter on the evidence regarding which debtor may be given zakat

وإن كان غنيا هو الغارم في الحمالة ‏"‏ والدليل على انه يعطى قدر ما يؤدي الحمالة لا اكثر
He is such a debtor who has incurred blood money or compensation upon himself, even if he himself is wealthy. He should only be given enough wealth to pay off his compensation, etc. He should not be given more than that.

Hadith Number: 2375
حدثنا ابو هاشم زياد بن ايوب ، والحسن بن عيسى البسطامي ، ويونس بن عبد الاعلى ، قالوا: حدثنا سفيان ، عن هارون بن رياب ، عن كنانة بن نعيم ، عن قبيصة بن مخارق ، قال: تحملت حمالة، فاتيت النبي صلى الله عليه وسلم اساله فيها، فقال:" نؤديها عنك ونخرجها من إبل الصدقة، ثم قال: يا قبيصة، إن المسالة حرمت، إلا في ثلاث: رجل تحمل حمالة حلت له المسالة حتى يؤديها، ثم يمسك، ورجل اصابته جائحة اجتاحت ماله حلت له المسالة حتى يصيب قواما من عيش او سدادا من عيش، ثم يمسك، ورجل اصابته جائحة، وفاقة حتى يتكلم او يشهد ثلاثة من ذوي الحجا من قومه انه قد حلت له المسالة، حتى يصيب سدادا من عيش او قواما من عيش، ثم يمسك فما سوى ذلك فهو سحت" ، قال البسطامي: ونخرجها من الصدقة
Sayyiduna Qabeesah bin Mukhaariq (may Allah be pleased with him) narrates that I took upon myself to pay blood money or compensation, so I came to the Noble Prophet (peace and blessings be upon him) to seek assistance regarding this. The Prophet (peace and blessings be upon him) said: "We will pay this amount on your behalf, and its payment will be made from the camels of Zakat." Then he said: "O Qabeesah, asking (for charity) is forbidden except for three persons. One is the person who has taken a debt or compensation upon himself; for him, it is permissible to ask until it is paid off, then he should refrain from asking. The second is the person who has been struck by a calamity and his wealth has been destroyed; for him, it is lawful to ask until his situation improves, then he should stop asking. The third is the person who has been afflicted by hardship and poverty, until three people from his tribe testify or bear witness regarding him that it has become lawful for him to ask; (then he may ask) until he acquires enough for his livelihood, then he should refrain from asking. Other than this, asking is forbidden." In the narration of Janab Bustami, it is stated: We will pay this debt from Zakat.
