في المرأة تحرم في الحج بغير إذن زوجها
If a woman dons ihram for Hajj without her husband's permission

١٥٣٥٧ - حدثنا ابو بكر قال: حدثنا عبد العزيز العمي قال: سئل (مطر) (١) وانا اسمع عن امراة استاذنت زوجها في الحج فلم ياذن لها، فاستاذنته ان تزور فاذن لها، فضمت عليها ثيابا لها بيضا (فصرخت) (٢) بالحج قال: فاتوا الحسن فسالوه، فقال ⦗٤١٨⦘ الحسن: (اللكعة) (٣) ليس لها ذاك.

حدثنا ابو بكر، قال: حدثنا عبد العزيز العمي، قال: سئل مطر وانا اسمع عن " امراة استاذنت زوجها في الحج فلم ياذن لها , فاستاذنته ان تزور فاذن لها , فضمت عليها ثيابا لها بيضا فصرخت بالحج، قال: فاتوا الحسن فسالوه؟ فقال الحسن: اللكعة ليس لها ذاك" ,
It is narrated from Hazrat Matar that a woman asked her husband for permission to perform Hajj, but the husband did not grant her permission. Then she asked her husband for permission to visit the House of Allah, and the husband granted her permission. Then the woman put on white clothes and began to recite the Talbiyah (the call for Hajj) aloud. People came to Hasan and asked him about this. Hasan said: "O fools! This is permissible for her." Hazrat Matar says that Hazrat Qatadah was asked about this, and he said: "That woman will be considered in the state of Ihram." Hazrat Matar says that then I went to Makkah Mukarramah and asked Hazrat Hakam bin Utaibah about this, and he said: "That woman is in the state of Ihram." Hazrat Matar says that then I assigned a person to ask Hazrat Ata bin Abi Rabah about this, and he said: "No! There is no coolness of the eyes in this for her; this is not for her."

15358 - Matar said: And Qatadah was asked, and he said: It is forbidden.

15359 - Matar said: So I went to Mecca and asked al-Hakam ibn (Utaybah) (1), and he said: It is forbidden.

١٥٣٦٠ - قال مطر: فامرت رجلا فسال عطاء بن ابي رباح فقال: لا، ولا نعمت عين؛ ليس لها ذلك.
قال مطر: فامرت رجلا فسال عطاء بن ابي رباح؟ فقال: لا , ولا نعمت عين ليس لها ذلك"
15360 - Matar said: So I ordered a man to ask Ata ibn Abi Rabah, and he said: No, and by the best of eyes; she does not have that.

١٥٣٦١ - حدثنا ابو بكر قال: حدثنا (وكيع قال: حدثنا) (١) ابو عوانة عن منصور عن إبراهيم قال: إذا كانت الفريضة وكان لها محرم، فلا باس ان تخرج ولا تستاذن زوجها.

حدثنا ابو بكر، قال: حدثنا ابو عوانة، عن منصور، عن إبراهيم، قال: " إذا كانت الفريضة وكان لها محرم , فلا باس ان تخرج ولا تستاذن زوجها"
Ibrahim says that when Hajj becomes obligatory and a woman has a mahram with her, then there is no harm if she sets out for Hajj without seeking her husband's permission.

١٥٣٦٢ - حدثنا ابو بكر قال: حدثنا فضيل بن عياض عن (هشام) (١) عن الحسن في المراة التي لم تحج، قال: تستاذن زوجها فإذا اذن لها فذاك احب إلي، وإن لم ياذن لها خرجت مع ذي محرم، فإن ذلك فريضة من فرائض الله ليس (له) (٢) (عليها) (٣) فيها طاعة.

حدثنا ابو بكر، قال: حدثنا فضيل بن عياض، عن هشام، عن الحسن، في " المراة التي لم تحج، قال: تستاذن زوجها فإذا اذن لها فذاك احب إلي , وإن لم ياذن لها خرجت مع ذي محرم , فإن ذلك فريضة من فرائض الله ليس له عليها فيها طاعة"
Hasan says regarding the woman who has not performed Hajj that she should seek permission from her husband; if the husband grants permission, then this is very good in my view, and if the husband does not grant permission, then the woman should go for Hajj with any of her mahram relatives, because Hajj is one of the obligations of Allah Almighty, and in this matter, there is no obedience to anyone (except Allah Almighty).
