٢٠٢٩٩ - حدثنا ابو بكر قال: نا يحيى بن سعيد عن ابن جريج عن عطاء قال: يتوارثان ما لم (يتلاعنا) (١).

(١) في [ك]: (يتلاعبا)، وفي [س]: (يتلاعنها).
Hazrat Ata (may Allah have mercy on him) says that until li'an takes place, they will remain heirs of each other.

Ibrahim (may Allah have mercy on him) said that until li'an takes place, they will remain heirs to each other.

٢٠٣٠١ - [حدثنا ابو بكر قال: نا وكيع عن سفيان عن حماد عن إبراهيم قال: إذا مات احدهما قبل اللعان (توارث) (١)] (٢).

Ibrahim (may Allah have mercy on him) said that if either of them dies before the process of li'an, they will be heirs to each other.

٢٠٣٠٢ - حدثنا ابو بكر قال: نا وكيع عن شعبة عن الحكم عن إبراهيم قال: يرثها.
Ibrahim (may Allah have mercy on him) says that a man will inherit from a woman. Hazrat Hakam (may Allah have mercy on him) says that the man will be flogged and he will inherit.

20303 - And (al-Hakam) said (1): He disciplines (2) her and inherits from her.

٢٠٣٠٤ - حدثنا ابو بكر قال: نا إسماعيل بن علية عن خالد عن عكرمة قال: في رجل قذف امراته (فماتت) (١) قبل ان يلاعنها قال: إن (كذب) (٢) نفسه جلد (وورثها) (٣) وإن اقام شهودا ورث، وإن حلف لم يرث.

Hazrat Ikrimah (may Allah have mercy on him) says that if a man accuses his wife of adultery and the woman dies before the process of li'an, then if the man retracts his accusation, he will be flogged and will be her heir; and if he presents witnesses, he will be her heir; and if he swears an oath, he will not be her heir.

٢٠٣٠٥ - حدثنا ابو بكر قال: نا عبد الاعلى عن سعيد عن قتادة عن جابر بن زيد انه قال: إذا مات احدهما قبل الملاعنة، إن هي اقرت بها رجمت وصار إليها الميراث، وإن التعنت ورثت، وإن لم تقر (بواحد) (١) (منهما) (٢) فلا ميراث لها ولا عدة عليها.

Hazrat Jabir bin Zaid (may Allah be pleased with him) says that if either of the two dies before the process of li'an, and then if the woman confesses to adultery, she will be stoned and the inheritance will be included in her wealth. And if she performs li'an, she will be an heir. If she does not confess to either of these things, she will not receive inheritance and 'iddah will also not be obligatory upon her.

٢٠٣٠٦ - حدثنا ابو بكر قال: نا (١) إسماعيل بن علية عن معمر عن الزهري في رجل قذف امراته ثم ماتت قال: يرثها ولا ملاعنة بينهما.

(١) في [أ، ب، س، هـ]: زيادة (عبد الأعلى عن سعيد عن قتادة عن).
Hazrat Zuhri (may Allah have mercy on him) says that if a man accuses his wife and then she dies, the man will inherit from that woman and there will be no li'an between them.

٢٠٣٠٧ - حدثنا ابو بكر قال: نا ابن فضيل عن عبد الملك عن عطاء قال: يجلد ولا ملاعنة بعد الموت.
Hazrat Ata (may Allah have mercy on him) says that in this case, he will be given lashes, and there is no li'an after death.

٢٠٣٠٨ - حدثنا ابو بكر قال: نا (محمد) (١) بن فضيل عن اشعث عن الشعبي قال: إذا قذفها ثم ماتت قبل ان يلاعنها قال: إن شاء اكذب نفسه وورث، وإن شاء لاعن ولم يرث.
ريفرينس و تحكيم الحدیث:
(١) في [جـ]: زيادة (محمد).
Hazrat Sha'bi (may Allah have mercy on him) says that if a man accuses his wife of adultery and she dies before the process of li'an, then if he wishes, he may retract his accusation and become her heir, and if he wishes, he may proceed with li'an, in which case he will not be her heir.
