٢١٨٠٩ - حدثنا ابو بكر قال: حدثنا علي بن مسهر عن الشيباني (عن الشعبي) (١) قال: قال عبد الله: إذا ادى المكاتب من رقبته فلا رد عليه في الرق (٢).
ريفرينس و تحكيم الحدیث:
(١) سقط الخبر من: [ز].
(٢) منقطع؛ لانقطاع ما بين الشعبي وعبد اللَّه.
Hazrat Abdullah says that when a mukatab has paid a portion of the price of his contract of manumission, he cannot return to slavery.

٢١٨١٠ - حدثنا ابو بكر قال: حدثنا حفص بن غياث عن الاعمش عن إبراهيم (١).

(١) منقطع؛ إبراهيم عن عبد اللَّه منقطع.
Hazrat Abdullah (may Allah be pleased with him) says that when a mukatab has paid one third of his contract amount, then he is considered indebted.

٢١٨١١ - وعن اشعث عن الشعبي قالا: قال عبد الله: إذا ادى المكاتب ثلث مكاتبته فهو (غريم) (١) (٢).

(٢) منقطع ضعيف؛ أشعث ضعيف.
21811 - From Ash'ath, from al-Sha'bi, they said: Abdullah said: If the mukatab pays a third of his contract, he is (a debtor) (1) (2).

٢١٨١٢ - [حدثنا ابو بكر قال: حدثنا عبدة بن سليمان عن (هشام) (١) بن عروة عن ابيه قال: إذا ادى المكاتب شطر مكاتبته فهو غريم يتبع] (٢).

Hazrat Urwah says that when a mukatab has paid half of the amount of the kitabah, then he is a debtor.

٢١٨١٣ - حدثنا ابو بكر قال: حدثنا عبد الوهاب الثقفي عن يحيى بن سعيد عن عروة ان مروان كان يقضي إذا ادى المكاتب نصف مكاتبته فهو دين يتبع به فذكرت ذلك لعبد الملك بن مروان فابى ان ياخذ به.
Hazrat Urwah states that Marwan used to give this ruling that when a mukatab pays half of his contract price, the remainder is considered a debt. I mentioned this matter to Abdul Malik bin Marwan, but he refused to accept it.

٢١٨١٤ - حدثنا ابو بكر قال: حدثنا ابن ابي زائدة ووكيع عن المسعودي عن القاسم عن جابر بن سمرة قال: قال عمر: إنكم تكاتبون مكاتبين فإذا ادى النصف فلا رد عليه في الرق (١).

(١) منقطع؛ القاسم لم يسمع من جابر بن سمرة.
Hazrat Umar (may Allah be pleased with him) says that you make slave scribes (mukatab) into scribes, and when they have paid half of the price of their contract, they cannot return to slavery.

٢١٨١٥ - حدثنا ابو بكر قال: حدثنا وكيع عن المسعودي عن الحكم عن علي قال: تجري فيه العتاقة في اول نجم (١).

(١) منقطع؛ الحكم لم يسمع من علي.
Hazrat Ali (may Allah be pleased with him) said that freedom will be granted from the payment of the first installment.

٢١٨١٦ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن هشام عن الحسن انه قال: في مكاتب عجز وقد ادى بعض مكاتبته وقد شرطوا عليه فهو رد، قال: إذا ادى النصف فهو غريم.
Hasan says that if a mukatab becomes unable to pay after giving some of the agreed amount, and his owners impose any condition on him, it will be invalid. When he has paid half of the agreed amount, he will be considered indebted.

Hazrat Muhammad bin Ziyad says that when he has paid half of the amount of the contract of emancipation, then he will be considered indebted.

٢١٨١٨ - حدثنا ابو بكر قال: حدثنا غندر عن شعبة عن منصور عن إبراهيم قال: إذا ادى الثلث او الربع او النصف فليس لهم ان يسترقوه.
Ibrahim says that when he has paid one third or one fourth or half, then they can no longer make him a slave.
