A Commission Agent Receiving a Fee

٢٣٤٧٢ - حدثنا ابو بكر قال: حدثنا (حماد) (١) بن خالد عن سفيان عن حماد انه (كان يكره) (٢) اجر السمسار إلا باجر معلوم.

Hazrat Hammad disliked taking a commission agent’s fee, except when the fee was fixed.

٢٣٤٧٣ - حدثنا ابو بكر قال: حدثنا عبد الرزاق عن معمر عن (ابن طاوس عن) (١) ابيه قال: قلت لابن عباس: ما لا يبيع حاضر لباد؟ قال: لا يكون (٢) سمسارا (٣).

(٢) في [هـ]: زيادة (له).
(٣) صحيح؛ أخرجه البخاري (٢٠٥٠)، ومسلم (١٥٢١).
Hazrat Tawus narrates that I asked Hazrat Abbas (may Allah be pleased with him) what is it that a townsman cannot sell to a villager? He replied that he cannot act as a broker (agent).

٢٣٤٧٤ - حدثنا ابو بكر قال: حدثنا حفص عن اشعث عن الحكم.
Hazrat Hakam, Ibrahim, and Hazrat Ibn Sirin state that if the purchase is made in cash, there is no harm in paying the commission agent's fee.

٢٣٤٧٥ - وحماد عن إبراهيم وابن سيرين (قالوا) (١): لا باس باجر السمسار إذا اشترى يدا بيد.

23475 - And Hammad from Ibrahim and Ibn Sirin (they said): There is no harm in the broker’s fee if he buys hand to hand.

٢٣٤٧٦ - حدثنا ابو بكر قال: حدثنا وكيع قال: حدثنا ليث ابو عبد العزيز قال: سالت عطاء عن السمسرة، فقال: لا باس بها.
Hazrat Laith says that I asked Hazrat Ata about giving commission. He replied: There is no harm in it.

Hazrat Sufyan disliked commission.
