Giving Mudarabah Wealth on Condition of Guarantee

٢٤١٢٨ - حدثنا ابو بكر قال: حدثنا الضحاك بن مخلد عن ابن جريج عن عطاء في الرجل يدفع إلى الرجل مالا مضاربة (على) (١) انه ضامن، قال: ليس بضامن.

(١) في [أ، ح، ز] زيادة (على)، وفي [جـ]: (قال).
Hazrat Ata was asked about a person who gives someone wealth for mudarabah on the condition that he will also be the guarantor of that wealth. He replied that he will not be the guarantor.

٢٤١٢٩ - حدثنا ابو بكر قال: حدثنا محمد بن (سواء) (١) عن سعيد عن قتادة عن عكرمة قال: كل شرط في مضاربة فهو ربا.

Hazrat Ikrimah says that every kind of condition in Mudarabah is usury. And this is also the statement of Hazrat Qatadah.

٢٤١٣١ - حدثنا ابو بكر قال: حدثنا غندر عن اشعث عن الحسن انه سئل عن رجل دفع إلى رجل مالا مضاربة وضمنه إياه، قال: الربح بينهما، ولا يلتفت إلى ضمانه.
Hasan was asked about a person who gave another person wealth for mudarabah and made him a guarantor? He replied: Whatever profit there is will be divided between the two of them, and attention will not be paid to his guarantee.
