The Pawnee Has More Right When the Pawn Is with Him Than Other Creditors

٢٤٤٢٦ - حدثنا ابو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن جابر عن عامر قال: إذا قبض المرتهن الرهن ثم مات الراهن وعليه دين، فهو احق به من الغرماء حتى يستوفي.
Hazrat Aamir says that when the mortgagee takes possession of the pledged property, and then the pledger dies and he has a debt, then the mortgagee has more right than the other creditors.

٢٤٤٢٧ - حدثنا ابو بكر قال: حدثنا وكيع قال: حدثنا إسرائيل عن جابر عن عطاء وسالم وعامر قالوا: إذا مات الراهن وعليه دين، فالمرتهن احق به من الغرماء حتى يستوفي.
It is narrated in the same way from Hazrat Ata, Hazrat Salim, and Hazrat Amir.

٢٤٤٢٨ - حدثنا ابو بكر قال: حدثنا حميد بن عبد الرحمن عن الحسن عن مطرف عن الحكم في الرجل يرهن الرهن ثم يموت صاحبه ولا يدع مالا غير الرهن، وعليه دين سوى (دين) (١) صاحب الرهن، قال: المرتهن احق بالرهن من غرماء الميت.

Hazrat Hakam was asked: A person gave something in pledge (rahn), then he passed away, and he left no wealth except the pledged item, and he has other debts besides the pledge? He replied: Among the creditors of the deceased, the mortgagee (murtahin) has more right to the pledged item.

٢٤٤٢٩ - حدثنا ابو بكر قال: حدثنا ابن إدريس عن هشام عن الحسن قال: إن الرهن المقبوض إذا مات صاحبه او افلس فالذي (هو في يده) (١) احق به، فإن لم يكن مقبوضا فهو بين الغرماء.

Hasan says that if there is possession of the pledged item and its owner dies or becomes insolvent, then the one who has possession of it has more right to it, and if there is no possession, then it will be distributed among the creditors.
